This focus group took place at the Università di Napoli ‘L'Orientale’ and was structured around recent female migration patterns in the south of Italy. The discussion included academics, artists, and care workers. The condition of women migrants was seen as one of precarity in the two main contexts we discussed: work and places of encounter. In an effort to move away from the purely material dimension of migration and deal with its emotional and creative sides, many facets of the question of being away from home and creating a new home were fleshed out: expectations, defence mechanisms, nostalgia, stereotyping, racism, and multiculturalism. Participants raised a wide range of issues and proposed different perspectives which also point to larger tensions and challenges in gender and race relations.  相似文献

The general consensus on the security-development nexus is that both are key to achieving sustainable peace in war-torn societies. However, this debate has largely taken place among international actors, with little empirical evidence about how security and development relate to each other or are even considered by local actors. The current paper applies the security-development nexus to the case of land restitution in Colombia. Following decades of internal armed conflict, in 2012 the national government passed sweeping land restitution legislation amid ongoing violence. Through in-depth interviews and focus groups with multiple actors involved in this process, ranging from international organisations to national government units, from regional institutions to local communities, the paper analyses the objectives, impact, challenges and opportunities for land restitution related to security and development. Undermining peace-building, a lack of coherence in the integration of security and development priorities limits the extent to which either supports, or is promoted by, land restitution efforts in Colombia. The paper concludes with reflections on how the security-development nexus may promote peace-building amid ongoing conflict.  相似文献

The aim of this case report is to describe two cases of sexual abuse by elderly subjects for which the Judge commissioned an expert psychiatric-forensic opinion. The elderly are generally believed to commit nonviolent crimes, whereas the two cases we observed feature forcible rape committed by elderly offenders, who showed no form of mental disease and had rationally planned their offense. They had never previously committed similar acts and had no history of homosexuality; both had been married for many years before the death of their wives and had adult children. Finally, no previous episodes of rape emerged in their personal histories during interrogations. The sociocultural context in which the crimes were committed was identical and arouses interest as regards both the method employed and how the crimes were discovered. The legal authorities then commissioned accurate investigations including medicolegal and psychiatric-forensic evaluations of the offenders and their victims.  相似文献

This paper examines the influences of candidate perceptions on Germany’s spring 2016 Länder election results. It takes a comparative approach, using a modified Michigan model on the data collected simultaneously in three Länder (Baden-Württemberg, Rhineland-Palatinate, and Saxony-Anhalt). It explains why the Green party was successful in Baden-Württemberg but not in the other Länder, the impact of the major candidates, and what distinguishes the influences of the current prime ministers running for these elections. Whereas Winfried Kretschmann’s (Green party, Baden-Württemberg) high impact on the election results was driven mainly by a warmth dimension (sympathy), Malu Dreyer (SPD, Rhineland-Palatinate) was viewed as being competent. Both candidates were assets to their parties and co-responsible for the results. In comparison, in Saxony-Anhalt, none of the candidates were as important to the outcomes of the electoral success.  相似文献

Private standards play a decisive role in tort law and in administrative law. Although they seem to be a perfect tool to achieve the goal of European integration, they tend to substitute democratic legitimacy with uncontrolled private governance. The loss of democratic control is accentuated by the failure of markets to provide sufficient incentives for standardising organisations to behave in a non-opportunistic manner. The dangers of cartelisation and oligopolistic behaviour are obvious. The approach to overcome these deficits is complex: on the one hand, an institutional governance of private organisations is necessary to incorporate third party interests in the process of enacting private standards; on the other hand, the legal effects of private standards have to be restricted to mere assumptions dependent on the democratic quality of their enacting process. The problem of democratic legitimacy is aggravated by the parallel substitution of state authorities' control by means of private certification organisations which control only the management procedures of firms. As these management systems are difficult to be evaluate, the opportunities for opportunistic behaviour amongst firms and certifiers increases. Moreover, markets themselves fail to discipline certifiers by virtue of a lack of observable factors which might indicate the quality of certification. Tort law, too, cannot fulfil that gap by providing liability for damages caused by undue certifications because tort law suffers from a variety of shortcomings such as missing protection of public goods and difficult assessments of causation linkages. In sum, the author argues for a mixture of market incentives, tort law and administrative law. Each sector must fill in the gaps left by the others.  相似文献

Delay undermines the performance of courts around the world. Its implications and possible solutions, however, are not so widely understood. The assessment of the efficiency of delay as a rationing mechanism requires a general theory, which looks at the effect on the number of conflicts, suits, settlements and trials. The outcome is somewhat disturbing: delay may be socially beneficial, but the assumptions seem prohibitively strict. The policy implications are that court delay is best reduced via increases in court fees and improvements in legislative and judicial quality.  相似文献

Despite the promises of some states to use lottery revenues to fund education, they may be guilty of robbing Peter to pay Paul. This study examines the question of revenue fungibility in the case of state lotteries. Using time-series analysis, the research suggests that education is not a big winner in state lotteries. Two different patterns of fungibility emerge from the analysis that are suggestive of underlying budgetary politics.  相似文献

Anecdotal evidence from forensic practitioners and studies conducted under controlled conditions have indicated that the reaction between 1,2-indanedione and the amino acids present in latent fingermark deposits is highly susceptible to ambient humidity. The addition of catalytic amounts of zinc chloride to the 1,2-indanedione working solution--usually in the order of 1:25 to 1:4 molar ratio (indanedione:zinc)--significantly improves the colour and luminescence of fingermarks treated under dry conditions but appears to have a negligible effect on fingermarks treated in humid environments. The results presented in this paper confirmed that zinc(II) ions added to the 1,2-indanedione working solution act as a Lewis acid catalyst, stabilising a key intermediate during a rate-limiting hydrolysis step. Furthermore, studying the reaction using a chromatography-grade cellulose substrate method previously reported confirmed that cellulose substrates play a major role in facilitating the indanedione-amino acid reaction by acting as a surface catalyst in the early stages of the reaction and by directing the formation of the desired luminescent product (Joullié's Pink).  相似文献

This paper explores the factors that affect firms’ propensity to engage in R&D cooperation using a CIS-3 sample of innovative firms located in seven European countries. It performs the analysis separately for the manufacturing and the service sectors in order to examine whether there are specific features that shape the service firms’ R&D cooperative behaviour in particular ways. Differences between the manufacturing and the service sectors in the cooperative behaviour of firms become much more evident once an appropriate structure of endogeneity is determined. We compare different countries because, so far, the empirical evidence produced comes from single countries or countries that are all quite homogeneous in terms of industrial structure. Instead, we consider also countries, such as transition economies, that have not been analyzed so far. We find that public subsidies positively affect firms’ propensity to engage in R&D cooperation in all countries, but they seem particularly important to enhance firms’ cooperativeness in the service sector. Implications for innovation policy are examined.  相似文献
