Article 43 of the 1907 Hague Regulations is a key provisionof the law of belligerent occupation. This essay examines howit has been understood by states and scholars, how it was developedby the Fourth Geneva Convention of 1949 and whether and howit was respected by the US and the UK during their recent occupationof Iraq. Under Article 43, an occupying power must restore andmaintain public order and civil life, including public welfare,in an occupied territory. Local legislation and institutionsbased upon such legislation must be respected by an occupyingpower and by any local authorities acting under the global controlof the occupying power. This general prohibition to change thelocal legislation also applies to post-conflict reconstructionefforts, including constitutional reforms, and changes of economicand social policies. The author examines the exceptions to theprohibition and assesses whether the widespread legislativeactivities by the occupying powers in Iraq fall under theseexceptions. He then analyses the question of whether the lawof military occupation ceased to apply in Iraq on 30 June 2004.It is also suggested that Article 43 applies to some peace operationsand provides a useful framework even for those peace operationsto which it does not formally apply. 相似文献
Suicide is a major public health problem. Preventive measures have been sought by identifying risk factors. This study evaluates the association of childhood abuse and neglect with suicidal behavior at the time of psychiatric hospital admission. A total of 120 subjects (72 females; mean age 42.5 +/- 15.6 years old) admitted from August 2006 to July 2007 completed the Childhood Trauma Questionnaire (CTQ) to assess severity of exposure to childhood maltreatment. Thereof 62 (51.6%) patients presented with suicidal behavior at admission. Patients who had attempted suicide had significantly higher CTQ scores. Regression analysis indicated that shorter illness duration and severity of childhood maltreatment were predictors of suicidal behavior at admission. The study showed that inpatients of a psychiatric unit of a general hospital who experienced severe childhood abuse or neglect were significantly more likely to present with suicidal behavior. History of childhood maltreatment should be evaluated as an associated risk factor of suicidal behavior at admission of psychiatric inpatients. 相似文献
This paper investigates informal mechanisms of knowledge transfer (KT) from a local university to entrepreneurial teams comprising students and recent graduates. While the extant literature on university-industry KT largely focuses on formal mechanisms aimed at stimulating entrepreneurial initiatives in high-tech (HT) sectors, it overlooks the effect of university-industry KT on nascent entrepreneurship in low-medium tech (LMT) sectors. To fill this gap in the literature, we carry out a mixed-method analysis that exploits a dataset of 154 new business ideas (and 535 team members) presented at a business plan competition in Rimini from 2010 to 2017. Our findings highlight a robust relationship between educational field and the R&D intensity of entrepreneurial projects: students take advantage of the knowledge acquired at university to develop entrepreneurial projects with higher technological content than those planned by non-graduates. Furthermore, the empirical evidence shows that the local university nurtures the formation of ties among students and recent graduates enrolled in the same courses and fosters their efforts to launch new ventures. Finally, the qualitative analysis identifies relevant and non-traditional mechanisms of KT that are being exploited by nascent entrepreneurs to develop their business ideas in the LMT and HT sectors.
We analyze the way in which individual academics and research groups organize their third mission activities before and after the institutionalization of third mission strategies by the university governing body. Drawing on the literature, we put forward an interpretative framework that links central entrepreneurial or engaged strategies with the way academics organize their third mission activities. Then, we propose an application of this frame to the case of the University of Florence (Italy), before and after its transition to more structured entrepreneurial and engaged models. We use a mix of quantitative and qualitative analysis. A cluster analysis allows identifying different types of academics involved in the third mission based on the way they organize their activities. Furthermore, a set of interviews to academics complements the comparison and the interpretation of the clusters obtained. The following paths of change emerge: (1) increased proportion of academics involved in third mission activities; (2) bottom-level initiatives that are aligned with central strategies; and (3) increased heterogeneity of bottom-level organization forms, with a relative loss of importance of the group dimension with respect to the individual academics and an increased specialization of research groups.
In this article, I examine some of the interactions between the crisis in Darfur and Chad through its increasingly complicated ethnic threads and explain how Chad slid back into authoritarianism in 2004. Factionalism broke down the mesh of ethnic politics into personalised rule and allegiances. The international response to the crisis in Darfur allowed the Chadian leadership to reinforce its position in the country. Ever since, a precarious equilibrium set in. Déby has become the longest-serving president in the history of modern Chad. Previously weakened by interfactional agreements and oil wealth expectations and then by the crisis in Darfur, the regime re-established internal and external means for preserving the status quo. This paper investigates the interplay between the Social Cash Transfer Programme (SCTP) and the Farm Input Subsidy Programme (FISP) in Malawi. We take advantage of data collected from a 17-month evaluation of a sample of households eligible to receive SCTP, which also provided information about inclusion into FISP. We estimate two types of synergies: i) the complementarity between SCTP and FISP, that is whether the impact of both interventions run together is larger than the sum of the impacts of these interventions when run separately, and ii) the incremental impact of receiving FISP when a household already receives SCTP, as well as the incremental impact of receiving SCTP when a household already receives FISP. The analysis shows that there are synergies between the two policy interventions, mainly in terms of incremental impacts of each programme over the other, in increasing expenditure, agricultural production and livestock. 相似文献
‘Euro Animal 7’ is the name given informally to 7 animal protection parties which represent voters in Cyprus, Germany, Netherlands, Portugal, Spain, Sweden and United Kingdom. These parties contested in the 2014 European Parliament (EP) election and gained representation in Germany and the Netherlands. Animal advocacy parties are also represented in the national parliaments of Portugal and the Netherlands.
Animal protection is an emergent issue in international politics and this research offers an account of the political positioning of these animal advocacy parties, analyzing their manifestos and the election results. While acknowledging that some parties have distinct ideological traits and some are still reclusive in the form of a single-issue party, this article argues that animal advocacy parties constitute a new party family in European politics. 相似文献
This article aims to re-examine the history of non-manual labour, beginning with an analysis of the evolution of general norms governing the contracts of private sector workers in Italy, from the post-First World War period up until the creation of the fascist corporate system in the 1930s. The starting point is the 1919 law that defined the specific characteristics of white-collar workers, expressed as a bond of trust and delegation on the part of employers, from whom legally established and binding guarantees were issued. These guarantees included the offer of permanent employment and the right to compensation should said employment be terminated. This law was reformed during the fascist era, but continued to influence the collective labour agreements stipulated by unions under the regime, contributing to the sustained social status of white-collar workers, particularly in comparison to manual labourers. This article will highlight the difficulties in applying these standards, and the legal and union disputes they generated, exploring an area rarely discussed by historians, while also, as a case study, scrutinizing the more advanced situation of employees in the banking sector – a sector which, from a regulatory and contractual point of view, represented the white-collar élite, as it would continue to do for a long time after the Second World War. 相似文献
