Regulatory studies assume that citizens can act as regulators to complement or correct failing state and market forms of regulation. Yet, there is a growing literature that shows that in reality citizens may fail to be effective regulators. This paper systematically analyses how power inequalities obstruct citizens in their regulatory roles. It compares four case studies with highly different social and political contexts but with similar outcomes of citizens failing to regulate risk. The case studies are analyzed by operationalizing sociological and political science ideas about manifestations of enabling and controlling forms of power in order to understand the way power inequalities obstruct citizens in their regulatory roles across diverse contexts. The article shows how citizens, from farmers and manual workers in both authoritarian developing and democratic developed contexts to even highly trained medical professionals from the US, have limited agency and are disempowered to act as regulators. Our analysis reveals that five patterns of disempowerment play a crucial role in obstructing successful society-based regulation: (i) dependency, (ii) capacity, (iii) social hierarchy, (iv) discursive framing, and (v) perverse effects of legal rights. 相似文献

Foreign-born workers have made significant and substantial contributions to economic productivity and new firm creation in the United States. This paper identifies predictors of entrepreneurial participation among foreign-born workers, combining nationally representative survey datasets covering the U.S. resident, college-educated workforce with country-of-origin macro statistics from the Global Entrepreneurship Monitor. Immigrants who come to the U.S. after earning university degrees abroad are more likely to own businesses than other college-educated, U.S. resident workers. However, much of their higher rate of business ownership can be attributed to differences in demographic characteristics, such as years of postgraduate work experience and marital status. By contrast, science and engineering-based business ownership is most common among immigrants who came to the U.S. to pursue higher education. Furthermore, after controlling for differences in human capital, U.S.-trained adult immigrants have higher propensity to own businesses than other foreign-born workers and native U.S. citizens, overall. U.S.-trained immigrants’ higher probability of business ownership is not explained by differences in human capital or other demographic characteristics, but does seem partly attributable to differences across foreign-born workers’ countries-of-origin. This paper examines how differences in sex drives between husbands and wives affect bargaining strengths during marriage and particularly at times when divorce might occur. The basic argument follows from the fact that sex drives vary over an individual's life cycle, and are systematically different for men and women. The spouse having the lowest sex drive at any time in the marriage has a property right over whether or not sexual intercourse will occur, with a consequent increase in bargaining power at the margin. This study examined the extent to which orientations to juvenile justice held by decisionmakers are related to their functional roles and educational backgrounds. Predictions concerning this question were drawn from both the literature on complex organizations and writings by scholars interpreting and forecasting the future of juvenile justice.The findings indicate that assignment to specific roles in the juvenile justice system is a significant predictor of commitment to either a rehabilitative or a just deserts model of juvenile justice. This effect appears to be modified to some extent by educational backgrounds and professional identifications. The implications of these findings for a continuation of the traditional rehabilitative ideal in juvenile justice are discussed. 相似文献

In a survey of 216 advocates in mediation, the successful mediator's ability to gain the confidence of the parties was cited as important to his or her success more frequently than were any of the skills used by the mediator to bring about agreement. This article discusses the means by which mediators gain the confidence of disputing parties. The article also discusses the different skill and attribute profiles of different successful mediators and the advocates' views of the reasons for mediator failure. The article considers the implications of its findings for mediators, trainers, and advocates, and concludes with suggestions for future research. 相似文献
