Trickster, Hero, Helper: A Report on the Lawyer Image

This study presents evidence that there are three distinct images of lawyers that are held by both lawyers and the public. The lawyers' professional subculture and values are explored through examination of the three images and their interrelationships as seen from differing perspectives. Implications are drawn concerning issues of lawyer identity, social responsibility, lawyer-client relations, and the unity of the bar. The images are related to other symbolic structures, including the adversary system, the family, and Western myth.     

Diverting and Abdicating Judicial Discretion: Cultural, Political, and Procedural Dynamics in California Juvenile Justice

Although tensions between substantive and formal rationality in the adult criminal justice system have received a great deal of attention, the existence of these tensions in the juvenile justice system has received little scholarly consideration. I seek to remedy this gap by exploring how punitive policies associated with the war on crime impact the formal and informal process of justice, the court community and work group, and the exercise of discretion in the juvenile courts. Drawing on qualitative data collected in three juvenile courts in Southern California, I identify the mechanisms by which prosecutors divert judicial discretion from the traditional rehabilitation-oriented bench officers to bench officers who are more accepting of the criminalization of juveniles. In addition, I investigate how and why rehabilitation-oriented bench officers at times abdicate their decisionmaking authority and make rulings that contradict their own assessments. My findings suggest that as the war on crime is extended to youth, the juvenile courts increasingly share the criminal courts' emphasis on offense rather than offender, enhanced prosecutorial power, and adversarial relationships within the court.     

Is Standing for Women a Stand Against Terrorism? Exploring the Connection Between Women's Rights and Terrorism

Previous large-N studies have found that the advancement of women's rights leads to a decline in conflict, but no large-N research has explored the possibility of a similar relationship between women's rights and terrorism. Nevertheless, policymakers have long argued that the advancement of women's rights forms a key component of counterterrorism policy. Simply put, we lay out a rationale for the argument that increased women's rights reduce the likelihood of terrorism. We test this hypothesis using CIRI's women's rights data combined with two datasets accounting for domestic terrorism and the production of transnational terrorism. While the results show that women's rights overall are not a panacea for both types of terrorism, the provision of women's rights is shown to have a negative relationship with domestic terrorism. States and international institutions should take the differing effects of women's rights across different types of terrorism into account when designing counterterrorism policies.

Meeting the challenges of the handicraft industry in Africa: Evidence from Nairobi

This article presents findings on observed productivity constraints of handicraft firms in Nairobi, Kenya. The goal is to help NGOs, intergovernmental organisations, and national governments in their efforts to foster local handicraft industries in Africa and beyond. One-hundred and two respondents were interviewed about their business, cost structure, hiring practices, and other intra-industry relationships. This article points out a number of practical problems hindering productivity and limiting livelihoods, including problematic labour practices, conditions of adverse selection, the context of proprietary information in small scale manufacturing, and the tendency of the industry toward hypercompetition.     

Workplace harassment: A test of definitional criteria derived from an analysis of research definitions and Canadian social definitions

Public awareness of the occurrence and effects of workplace harassment continues to grow. However, despite increasing awareness, ambiguity remains about how harassment is defined and, consequently, how to determine whether a questionable situation should be judged as harassment. For this research we reviewed definitions of workplace harassment and identified four elements that were frequently included as criteria for making judgments of whether harassment had occurred (i.e., repetition, intent, perceived intent, consequences). In two separate studies, fictional scenarios were used to evaluate the extent to which participants' judgments about harassment were affected by the presence or absence of the four elements. Ratings of the scenarios provided by student participants (study one; N = 160) and a convenience sample of community participants (study two; N = 292) with varying levels of work experience and diverse professional backgrounds were analysed. According to our results the four elements significantly influenced participants' judgments of harassment. The intent of the harasser had the strongest and most consistent effect on harassment judgements and whether the behaviour was repeated had the weakest and least consistent effect. In addition to the unique effects of the individual elements, significant interactions between the elements emerged and suggest that harassment judgements depend on the interplay of a variety of factors. Though the results of these studies add to the growing body of research that focuses on defining workplace harassment, they also highlight the need for additional research in the area.
