In this article, we examine the continuity of harms and traumas experienced by women before, during and after war and other mass violence. We focus on women because of the particular challenges they face in accessing justice due to patriarchal structures and ongoing discrimination in the political, economic and social, as well as legal spheres, and because of the gendered nature of the crimes and harms they experience. We use the four key pillars of transitional justice identified by the United Nations as a framework to analyse how these harms are addressed in the context of criminal prosecutions, truth commissions, reparations and institutional reform. We conclude that a gender-transformative approach to transitional justice that focuses on transforming psychosocial, socioeconomic and political power relations in society is needed in order to attain human rights for women and build a sustainable peace. 相似文献

Ronald Dworkin’s Justice for Hedgehogs defends liberal political morality on the basis of a rich account of dignity as constitutive of living well. This article raises the Rawlsian concern that making political morality dependent on ethics threatens citizens’ political autonomy. Thereafter, it addresses whether the abandonment of (erinaceous) ethical foundations signals the demise of Dworkin’s liberalism and explores the possibility of laundering his conception so as to facilitate a marriage between the political philosophies of Rawls and Dworkin. The UNESCO World Heritage List is an international inventory of natural and cultural sites that are, according to the conception of its initiators and administrators, of importance for mankind as a whole. The evaluation of the list can be interpreted as a specific form of the social production of the valuable. Focusing on the cultural sites, the paper argues that the production of World Heritage renders a form of practical universalization of the value of particular goods. It centres on the questions of how a site is produced as culturally valuable, how its value is universalized, and what role is played by the concept of authenticity in the process. Two aspects of the evaluation practice are examined with regards to the production of universalization: working with and working on the assessment criteria. Building on the transactionalist paradigm in the tradition of Karl W. Deutsch as well as on Arndt Sorge’s theory of tiered social spaces, this study examines why everyday actions and attitudes are more centered on Europe (i.?e. “Europeanized”) in some EU member states than in others. Analyzing a variety of survey data on the EU-27 countries with partial correlation models, it is shown that the macro-level determinants of Europeanization differ between actions and attitudes. While actions are more Europe-centered in small and affluent countries, attitudes are more Europe-centered in post-communist states as well as in countries that are located in the geographical center of the EU and that do not have a protestant religious tradition. Contrary to transactionalist theory, the Europeanization of actions does not coincide with the Europeanization of attitudes: “doing Europe” and “feeling Europe” do not go hand in hand. 相似文献

Although political decisions and the mobility of capital have advanced the integration of markets at the European and the global level, durable transnational bargaining relationships between labor and capital remain rare. Drawing on case studies in two automobile companies the article explores whether and how class-based conflicts are institutionalized in the transnational social space of European industry. Concepts are borrowed from the theories of Pierre Bourdieu and neo-institutionalism to develop a relational, space-sensitive understanding of power lacking in existing perspectives, such as the power resource approach. This allows for a better grasp of the institutions shaping transnational employment relations in the two studied companies, Volkswagen and General Motors-Opel, as well as of the differing stability of these institutions. 相似文献

Why have some Mexican states proceeded faster than others in the revolutionary transformation of overhauling criminal procedure? Contributing an original index of criminal procedure reform across Mexico's 32 states from 2002 to 2011 and building on existing research on policy diffusion, this article seeks to answer this question. It finds that the 2008 constitutional reform at the federal level exerts a strong positive effect (federal mandate); being situated in a neighborhood of states that have reformed has a counterintuitive negative effect (spatial proximity); and having a governor from the same party as governors of other states that have reformed has a positive influence (network affinity). These findings yield a better understanding of the vertical, cross‐level and horizontal, cross‐unit diffusion of reform, with implications for understanding how to overcome challenges to criminal justice reform in Mexico, Latin America, and elsewhere. 相似文献
