Copyright and live streaming of sports broadcasting

The inception of live streaming technology has rapidly changed the way in which sporting events are transmitted. The unauthorised retransmission of live sports telecasts over the Internet has become one of the main concerns in sports media, where broadcasters have lost billions of dollars’ worth of sports broadcasting contracts and sponsorship deals. The scale of this problem has caused serious harm, both to sports rights-holders and to broadcasters. Legislative reforms are required in order to balance the public’s ever-increasing desire for convenient ways to view digital materials against the legal rights of the owners of the material, while also aiming to maintain a forward-looking perspective in an attempt to foresee potential technological advancements that may pose considerable challenges to the traditional copyright law. This article analyses how the concept of live streaming of live sports has changed the legal landscape.     

Fifty years of research on illegal enterprise: an interview with Mark Haller

This interview with professor emeritus Mark Haller, conducted in August 2010, discusses Haller’s career and his research on organized crime. Haller studied crime in Chicago and Philadelphia, in particular the business activities of Al Capone and Angelo Bruno and their respective associates, concluding that illegal businesses have to be distinguished analytically and empirically from fraternal organizations of criminals.     

Reassessing the Association between Gun Availability and Homicide at the Cross-National Level

This paper had two objectives. First, to examine the association between gun availability, gun homicide, and homicide in a manner that better accounts for potential simultaneity than previous cross-national research. Second, to examine the manner that the relationship between gun availability and violence is shaped by socio-historical and cultural context. The results lend little support to the notion that gun availability operates uniformly across nations to influence levels of violence. Rather, these results suggest that the nature of the relationship between gun availability and violence is shaped by the socio-historical and cultural processes occurring across nations.     

Psychosocial influences that motivate young offenders to engage in a non-custodial community intervention

Offender programmes do not fully consider how psychosocial factors influence individual engagement within interventions. While factors associated with offending behaviour are well-known, their influence on motivational engagement is not clear. The present study of 109 adolescent offenders in a non-custodial community intervention explored the influence of aggression, antisocial behaviour in the community, problematic and disruptive behaviour in school, and parental bonding and self-esteem on reported motivation to engage with a non-custodial intervention. Regression and correlational analysis revealed relationships between these variables and four subtypes of motivation (i.e. intrinsic and extrinsic motivation, identified regulation and amotivation), although results in respect of self-esteem were mixed. The findings highlight the multidimensional and complex nature of motivation, and support the need to internalise extrinsic motivations through the promotion of self-autonomy and competence within intervention programmes in order to maximise engagement.     

Reassessing the focus of transitional justice: the need to move structural and cultural violence to the centre

After over six decades of evolution, transitional justice remains focused on courts and commissions, evidenced by the allocation of international attention and resources. This is understandable given that courts and commissions are ideal platforms to hold perpetrators to account. While violent individuals and events can be addressed through courts and commission, what cannot be adequately addressed is the structural and cultural violence that makes mass atrocities possible, and remains intact in spite of truth and accountability. Structural and cultural violence manifests as systemic vulnerability and dehumanization, and it is this type of built-in violence that continues to plague countries where transitional justice has been pursued, for example the criminalization and repression of communities in South Africa, or the forced evictions that occur daily throughout Cambodia. This article argues that it is this type of violence which should become the central focus of transitional justice.     

Recalling MPs: Accountable to Whom?

The legislation on recall of MPs, introduced as a response to the parliamentary expenses scandal, was presented as filling an accountability gap. The nature of this alleged gap is examined, and it is argued that the accountability of Members of Parliament is more complicated than the recall proposal suggests. This includes issues about the regulation of parliamentary standards. Finally, the recall proposal is located within the context of discussion about the condition of representative democracy.     

What is language? A response to Philippe van Parijs

When we consider the issue of linguistic justice, we must define what we mean by language. Standardisation of languages is closely associated with the development of the nation state, and the de Saussurian conception of language as system is in concert with nationalism and its divisions. In the early twenty-first century, however, this view of the world as a mosaic of stable national monolingualisms is outdated. In a globalising world, much of the political, social and economic structure that is developing is transnational and patterns of contact, both real and virtual, have become extraordinarily complex. In the resulting communities of communication of this superdiverse world, much language practice is more function driven than in the recent past. New practices mean that we cannot consider questions of linguistic justice in this new world order using the linguistic toolkit of the old. The flows, exchanges and networks of globalisation present us with a new paradigm and we need to recalibrate concepts.
