Identifying Judicial Empathy: Does Having Daughters Cause Judges to Rule for Women's Issues? 下载免费PDF全文
In this article, we consider whether personal relationships can affect the way that judges decide cases. To do so, we leverage the natural experiment of a child's gender to identify the effect of having daughters on the votes of judges. Using new data on the family lives of U.S. Courts of Appeals judges, we find that, conditional on the number of children a judge has, judges with daughters consistently vote in a more feminist fashion on gender issues than judges who have only sons. This result survives a number of robustness tests and appears to be driven primarily by Republican judges. More broadly, this result demonstrates that personal experiences influence how judges make decisions, and this is the first article to show that empathy may indeed be a component in how judges decide cases. 相似文献

The European Union establishes external relations with third countries in different ways. Network governance is considered as an organisational opening that provides for more cooperative flexibility and inclusion. In this article, I examine to what extent network governance enables Switzerland's inclusion in the European energy sector. I argue that, as the network governance of EU energy policy becomes more institutionalized – from the regulatory forums of Florence and Madrid to the European Regulators Group for Electricity and Gas (ERGEG) – Switzerland tends to be excluded. I further argue that this lack of political inclusion is partly compensated by patterns of market governance that favor Swiss firms. Neither network nor market governance, however, is a sufficient form of coordination and traditional options such as bilateral agreements (electricity) and autonomous adaptation (gas) seem inevitable. 相似文献

Drawing on insights from economics, psychology, sociology, political science, and policy sciences, this article proposes a definition and measurement strategies for policy bubbles. A policy bubble is a real and/or perceived policy overreaction that is reinforced by positive feedback over an extended period of time. Positive feedback is here integrated in a model of human herding as the key factor that propels this process but also as a key generator of change. The process is conceptualized in terms of the formation, growth, and burst of policy bubbles. This causal‐explanatory understanding of the term allows for the possibility that different modes of policy overreaction lead to different types of human herding, thereby resulting in different types of policy bubbles. 相似文献

This article develops a strategic agenda concerning regulatory agencies' strategic communication in light of the reputation literature. It highlights the main strands in this literature, presents the fundamental findings discovered so far, responds to the critiques that have recently surfaced, and offers guidance about where scholarship on strategic communication might most profitably head. The critiques discussed here centre on two aspects: (i) the claim that an agency's communication choices are to some extent driven by the distinctive logic of the media rather than by reputational concerns, and (ii) the argument that strategic communication provides only short-term solutions to emerging threats and is therefore overemphasized in the literature. Future agendas include, for example, the selection of audience segmentation strategies, and the management of competing and even contradictory communication for segmented audiences when agencies enjoy exclusive jurisdiction, as opposed to cases in which other agencies share the same stage. 相似文献

Adult caregivers (n = 184;Mage = 43.9 years old) working at a non-profit, eldercare program at five geographically diverse sites located in the self-contained, island state of Tasmania, Australia, completed a set of self-report measures. Results across the five sites indicated that respondents experienced a relatively strong sense of self-efficacy toward making a difference in their local community. However, there were significant differences (controlling for social desirability) when comparing caregivers from rural northern (n = 45) with urban southern (n = 139) communities, with rural caregivers claiming stronger sense of common mission with others, reciprocal responsibility to help others, and caregiver satisfaction, plus lower disharmony with other members and caregiver stress in helping the elderly than urban caregivers. Implications suggest that community self-efficacy may be high among eldercare staff, but their sense of community and caregiving perceptions may reflect geographic differences, especially in Tasmania. 相似文献
