A Case Example of Asphyxia Due to Occupational Exposure to Airborne Chemicals and Review of Workplace Fatalities

Although worker injury and fatalities have decreased since adoption of the Occupational Safety and Health Act in 1970, it remains an important safety issue. This article describes a 27‐year‐old white male who died from occupational exposure to airborne chemicals. Several trends in the last several decades, both in the types of injuries and the occupations associated with fatalities, are noted. Additionally, individual risk factors such as age, gender, chronic disease, smoking, and alcohol and drug use are implicated in worker health and safety. The role of the forensic pathologist in the investigation of workplace deaths is highlighted, in addition to the future of occupational safety and current improvements brought about by such incidents.     

Inter-/Intra-observer Reliability of Hand Assessment Using Skin Detail: A Count-based Method

Skin detail of the hand is used in photographic comparisons, yet its reliability has not been evaluated. This study examines a count-based method for documenting skin features. In Part I, 14 individuals counted skin features on 40 color images of the hand, three of which were repeated. An average correlation value of 0.557 was obtained for interobserver assessment; values ranged from 0.545 to 0.832 for intra-observer assessment. The variation in correlation values for hands suggests that there are certain distinguishing characteristics that increase reliability. In Part II, 17 examiners assessed 20 nonrepeated grayscale images of hands by circling skin features. An average correlation value of 0.674 was obtained, but visual assessment of examiner markings suggested some examiners grouped features whereas others viewed them individually. The results suggest further research is warranted, some hands may be more suitable for comparisons, and a standardized method for examining skin features is needed.     

Incorporation of the European Convention on Human Rights into UK Law: Implications for education

This article focuses on the UK government's proposal to incorporate the European Convention on Human Rights into UK law, and the consequences of incorporation for the individual in the context of education. The first part of the article explores the mechanisms proposed for bringing about incorporation, and stresses in particular the importance attached by the government to upholding the fundamental principle of the sovereignty of the UK Parliament. In this context it emphasises the government's decision to deny to the British courts the capacity to strike down legislative provisions as being incompatible with Convention rights. The second part of the article goes on to explore (highly selectively) a number of key areas in which incorporation of the ECHR has the potential to enhance individual rights in the field of education, including parental choice of school, collective worship and religious education, and aspects of the secular curriculum. The discussion emphasises strongly the likely significance of the UK government's reservation to the second sentence of Article 2 of the First Protocol to the ECHR. Broadly, the conclusion drawn is that the incorporation of the Convention will have only a very marginal impact on the reality of individual rights to education.     

Terror in Japan

Observers of early twenty-first-century Japan commonly note economic, political, and social crisis, on the one hand, and pessimism, lethargy, or helplessness about the possibility of reform, on the other. Yet Japan's civil society was idealistic and energetic in the early postwar decades. What happened? The reform movement that captured much of the vitality of the early postwar decades was either foreclosed, as many were co-opted in the “all-for-growth” economism, consumerism, and the corporation, or crushed in successive waves of repression of dissidence as the cold war order took shape. Political parties sacrificed broad vision and ideals to narrow-interest articulation. While the mass base of the reform movement was discouraged, demoralized, and depoliticized, one minority in the late 1960s turned to violent revolution and another in the late 1980s turned inward to seek spiritual satisfaction. Both paths led to violence. This article looks at the course of the student movement between the late 1940s and the late 1970s, with particular reference to the Japan Red Army, and at the new religious movement Aum Supreme Truth in the 1980s and 1990s. Both adopted “terrorist” tactics, by almost any understanding of that term. However, they were children of their times, reflecting the same deep social, political, and moral problems that Japan as a whole continues to face in the early twenty-first century.
