CHILD PROTECTION MEDIATION: A 25-YEAR PERSPECTIVE

This article reviews the creation, development, and growth of child protection mediation (CPM) in the United States. Starting with a few pilot projects in the 1970s, CPM has grown throughout the country. The article traces child protection's development through the publication of the Resource Guidelines and Model Courts and then discusses what the necessary ingredients for a mediation program are. Mediation is then discussed from a judicial perspective. Barriers to mediation are listed, followed by a discussion of special issues that arise when developing and maintaining CPM programs. The article concludes with the observation that CPM is now recognized as a best practice by most judges and court improvement professionals and that it continues to grow.     

Regulatory novelty after financial crises: Evidence from international banking and securities standards, 1975–2016

Financial crises are often presented as triggers for important innovations in international regulation of financial markets, but existing evidence for this claim primarily derive from the analyses of individual initiatives, assessed against noncomparable benchmarks. In order to provide systematic evidence of financial crises' impact on international financial regulatory change, this paper develops a novel text-as-data approach to measure regulatory novelty. We use this approach to analyze the full population of international banking and securities standards between 1975 and 2016. Contrary to theoretical expectations, our empirical findings indicate rules designed by international banking and securities regulators following financial crises are on average as likely to build on existing international regulations as those designed before a crisis. We also find that international banking rules published after the 2008 Global Financial Crisis are an important exception.     

From ‘Tramp Stamps’ to Traditional Sleeves: A Feminist Autobiographical Account of Tattoos

ABSTRACT

In this article I use a feminist autobiographical approach to present my ‘tattoo narrative’ as a gendered, embodied account in which I map out key moments in my life over two decades through the images inscribed on my skin. Specifically, I examine how my bodily modifications have magnified the social responses to my body as a woman. For example, as a teenager, I acquired a naval piercing and trendy ‘feminine’, discretely located tattoos to satisfy a heterosexual male gaze. In contrast, as a woman in my late thirties, my tattoos satisfy a different purpose. They are larger, bolder, and more ‘masculine’ in line with the evolution of my feminist politics. However, as an academic, the social responses to my tattoos are more complex. In class defined social spaces such as the university where I work, my tattoos cause trouble because they challenge gendered and classed norms for femininity. I conclude by calling for women to engage in autobiographical writing about bodily modification as a critical feminist political act.     

Community Participation in Restorative Justice: Rituals,Reintegration, and Quasi-Professionalization

Abstract

Community has long been identified as the key third party in restorative justice processes. However, when it comes to both theorizing community in restorative justice and the actual practice of community participation, conceptual clarity is lacking. A careful reading of the sociological literature on restorative justice and community point to two main reasons why we want to encourage community participation: the creation of effective ritual and offender reintegration. In this article, we present findings from an empirical study of conferencing. We explore varieties of community participation and discuss the benefits and tensions that arise when community participation becomes a formalized element of a mainstream restorative justice practice.     

Dating Violence Experiences of Lesbian,Gay, Bisexual,and Transgender Youth

Media attention and the literature on lesbian, gay, and bisexual youth overwhelmingly focus on violence involving hate crimes and bullying, while ignoring the fact that vulnerable youth also may be at increased risk of violence in their dating relationships. In this study, we examine physical, psychological, sexual, and cyber dating violence experiences among lesbian, gay, and bisexual youth—as compared to those of heterosexual youth, and we explore variations in the likelihood of help-seeking behavior and the presence of particular risk factors among both types of dating violence victims. A total of 5,647 youth (51 % female, 74 % White) from 10 schools participated in a cross-sectional anonymous survey, of which 3,745 reported currently being in a dating relationship or having been in one during the prior year. Results indicated that lesbian, gay, and bisexual youth are at higher risk for all types of dating violence victimization (and nearly all types of dating violence perpetration), compared to heterosexual youth. Further, when looking at gender identity, transgender and female youth are at highest risk of most types of victimization, and are the most likely perpetrators of all forms of dating violence but sexual coercion, which begs further exploration. The findings support the development of dating violence prevention programs that specifically target the needs and vulnerabilities of lesbian, gay, and bisexual youth, in addition to those of female and transgender youth.
