A growing body of evidence shows that minorities are disproportionately the targets of police brutality, but important theoretical questions about the causes of that inequity remain unanswered. One promising line of research involves structural‐level analyses of the incidence of police brutality complaints; however, existing studies do not incorporate variables from alternative theoretical explanations. Drawing on the community accountability hypothesis and the threat hypothesis, we tested the predictions of two prominent structural‐level explanations of police brutality in a study of civil rights criminal complaints. The study included cities of 150,000+ population (n = 114). The findings reveal that two community accountability variables—ratio percent Hispanic citizens to percent Hispanic police officers and the presence of citizen review—were related positively to police brutality complaints, partially supporting that perspective. Two threat hypothesis measures of threatening people—percent black and percent Hispanic (in the Southwest)—were related positively to complaints, as predicted. The relative degree of support for the two hypotheses is assessed.  相似文献

A number of recent studies have explored the consequences ofinterracial peer effects on the academic and social performanceof minority students. This article contributes to that discussion,focusing, however, on perceptions rather than behaviors. Theanalysis suggests that exposure to white peers is associatedwith declining perceptions of racial justice among black andLatino high school students. While cautioning against causalinterpretations of this finding, the article suggests that theintegrationist aims of Brown v. Board of Education will notbe satisfied without more thoughtful and vigorous desegregationefforts.  相似文献

Conclusion The Regulations appear to have reinforced the protection available to software producers under United Kingdom law. The provisions of the Software Directive and the Regulations are complex and not without significant inconsistencies which are likely to prove to be a source of litigation. The drafters of the Regulations chose, unlike many of its European partners, not to adopt the wording of the Software Directive but to write their own interpretation, adding an element of uncertainty to the law in this area, which is perhaps inevitable bearing in mind the linguistic problems of translating and interpreting any directive coupled with the ambiguity and omission of definitions of several key terms. More important, however, than any academic argument will be the practical impact of the new law and its effectiveness in achieving its aim.  相似文献

The present paper operationalizes and empirically tests the most recent theoretical speculations of Hirschi and Gottfredson regarding an individual level characteristic of self-control and its relation to earlier specifications of control theory as well as the literature on personality. Linkages are drawn between their broad delineation of self-control and personal disorders of hyperactivity, impulsivity, attention deficits, and minor conduct problems. Psychologists disagree about whether such disorders represent single or multiple traits and whether both behavioral and cognitive measures can appropriately depict personality characteristics. Employing structural equation techniques, support for several propositions derived from Gottfredson and Hirschi's thesis is found: Self-control subsumes several personality disorders and is significantly comprised by early behavioral indicators of aggression and fighting, is inversely related to other elements of the social bond, is moderately stable over a short period of time, and significantly predicts criminal convictions. However, questions remain regarding the ubiquity of self-control, the magnitude and meaning of stability, and the power of this perspective to explain all forms of self-reported delinquency.  相似文献

Conclusion Certain components of the British system of legal aid, especially the duty solicitor scheme, could beneficially be introduced in modified form into German criminal procedure. Conversely, some points of German law could benefit the British system, such as less rigid adherence to the autonomy principle. Conclusion We have in this paper tried to set out a framework which can facilitate analysis of the current and future situation of traditional rulership in contemporary African society. Our presentation of a proposed model for such an analysis is no doubt still in its elementary stages of formation. Much more work needs to be done. Nevertheless, our analysis has revealed certain salient elements and uncovered certain unresolved issues. If traditional rulers genuinely care about their own future they will have to devise techniques of legitimation which not only endear them to the government and the non-traditional elites, but also, and more importantly, to the mass of the people. True, the original role of the traditional rulers may be no more; still, it may be possible to salvage what is left.  相似文献
