Vergleichende Politikwissenschaft in Deutschland — Themen, Konjunkturen, Tendenzen, internationale Einordnung

The sub-discipline of Comparative Politics is characterized by a specific subject-matter, the systematic analysis of political systems and their sub-systems, and the application of specific comparative methods. This overview, therefore, deals with both new developments in comparative methodology and their epistemological foundations and recent substantive concerns and developments. Thereby, the strong linkages within the European and international context are also taken into account. It becomes apparent that increasing international tendencies of “globalization” and the internal dynamics of political systems interact in ways which lead to a blurring of the sub-disciplines of Comparative Politics and International Relations. These tendencies are, so far, not adequately dealt with, neither theoretically nor methodologically. On the whole, this review of German Comparative Politics as a very active and, by now, quantitatively dominating sub-discipline concludes with a moderately positive assessment. In this respect, some personal views of the author, who has been involved in these developments for more than forty years now, are probably inevitable.

技术分摊是专利侵权损害赔偿额计算中适用的规则,它剔除了非专利因素创造的利润,使赔偿数额的计算更为科学合理.在英美法系的美国和大陆法系的日本,技术分摊规则的理论研究和司法运用有着悠久的历史,形成了许多技术分摊规则的理论学说和经典判词,颇具借鉴意义.我国司法实务中已经出现适用技术分摊规则的案例,但其操作比较粗放、随意,建议我国以市场价值分析法确定技术分摊比例,并由侵权人承担举证责任,以使损害赔偿额的计算更加精细化、科学化.     

幼儿面部表情识别能力培养的实验研究

为了考察幼儿情绪识别能力培养的效果,我们对50名儿童进行情绪识别培养,结果发现:幼儿情绪识别能力培养效果明显;不同年龄段培养的效果差异显著,3岁效果最明显,3岁也是正性情绪培养的关键期;正性情绪识别能力培养存在性比差异,女生比男生快;幼儿负性情绪识别能力培养3、4岁都有质的改变。结果提示:幼儿情绪识别能力发展迅速,培养效果明显。不同类型情绪培养效果有分离,正性、负性培养作用明显。     

The use of linear dichroism in forensic fibre examinations — Part 6. Validation and practical aspects of MSP-PPL

This paper summarizes the results of previous work on the microscopic observation of linear dichroism found in dyed fibres (polyesters, polyamides, wool, silk, cotton, viscose, acrylics and acetates) and in pigmented fibres as well as the measurements on these fibre classes using microspectrophotometry with plane polarized light (MSP-PPL). The validation of this method is discussed and a practical tool is proposed for comparing fibre traces with control fibres. The limitations and strengths of this method are also revised.     

Experimental Study of Bite Mark Injuries by Digital Analysis

Abstract: This study was based on a morphometric analysis of bite marks starting from the quantitative definition of the anterior teeth by the geometric acquisition of the “injuries,” using bite marks impressed on pig skin and plastic. Each mark was photographed and acquired. A dedicated program automatically supplied the values of the shape factors and the areas of the pattern geometric figures. The values obtained for the homologous samples were compared to the heterologous values. Statistical comparison was made of the sets by linear regression, determining the correlation coefficient and the determination coefficient for each value. Results showed only 4.8% and 2% of overlap between homologous and heterologous values. This study was carried out in attempting to quantitatively define the anterior teeth of the human dentition and the procedure described and the results obtained support the advantage of morphometric studies and computer‐aided programs in this study of bite marks.

2006年3月1日起施行的《中华人民共和国治安管理处罚》第七十二条第三款将吸食、注射毒品的行为以法律的形式确定为违法行为予以治安行政处罚。站在坚持吸食、注射毒品非犯罪化的立场,对该类行为从犯罪学的角度进行综合考察、借鉴恢复性司法理念,对吸食、注射毒品者在采取非刑罚处罚的基础上,如何施以人性关怀、力求为减少和控制吸食、注射毒品行为略陈管见。
