The contractual alternative to patents

A patent grants the holder a monopoly over the use of the patented invention for a specified time period. Although economists are generally opposed to monopoly, there seems to be a general consensus that the patent system is desirable.¹ The rationale for the patent system is that without ownership rights in inventions, there would not be optimal allocation of resources to inventive activities, just as with any other valuable resource over which there are not well-defined property rights. However, the patent system, since it confers monopoly rights, has its drawbacks as well. If independent parties are working simultaneously toward an invention, the first to produce the invention will receive a monopoly over its use, even though others may have been only a month behind. This may encourage inventors to work too intensively toward a patent, and could also have the effect of producing monopoly in a market that was characterized by competition before the patent was issued. In addition, competitors have an incentive to develop substitute processes to avoid infringement of the patent, when the use of the patented process would be more economical. A substitute for patents which provides ownership rights in an invention without governmental grant of a monopoly is the trade secret. The purpose of this paper is to introduce and develop the idea of the law of trade secrets as a contractual alternative to patents.     

Cognitive-behavioral rehabilitation for high-risk violent offenders: an outcome evaluation of the violence prevention unit

Rehabilitation programs for adult violent offending are still novel, and few published studies examine the recidivism outcomes of those who complete such programs. This study describes a New Zealand prison program for high-risk violent men. The program is intensive and cognitive behavioral. Preliminary outcome data are presented for three indices during 2 or more years of follow-up: nonviolent reconviction, violent reconviction, and subsequent imprisonment. In comparison with untreated offenders, treated men were less likely to be reconvicted of a violent offense, and those who were took longer to fail. There was also a 12% difference in favor of the treated men on the two other indices, nonviolent reconviction and reimprisonment. The authors conclude that the program shows early promise and that further evaluation with a larger sample of treated men will be important in clarifying whether the program is having a differential impact on violent versus nonviolent offending.     

Capacity to Sustain Sustainability: A Study of U.S. Cities

Why do some governments implement more sustainability practices than others? Based on a national survey of U.S. cities, this article finds moderate levels of sustainability efforts and capacity in U.S. cities; about one‐third of the sustainability practices identified in this article have been implemented. The authors conclude that, first, capacity building is a useful conceptual focus for understanding sustainability implementation in U.S. cities. Capacity building involves developing technical and financial support and increasing managerial execution. Second, sustainability is strongly associated with managerial capacity, which includes establishing sustainability goals, incorporating goals in operations, and developing a supportive infrastructure. Third, getting stakeholders involved furthers the capacity for sustaining sustainability efforts. Citizen involvement is strongly associated with securing financial support for sustainability.     

Assessment and management of risk for intimate partner violence by police officers using the Spousal Assault Risk Assessment Guide

Intimate partner violence (IPV) is a crime that is present in all countries, seriously impacts victims, and demands a great deal of time and resources from the criminal justice system. The current study examined the use of the Spousal Assault Risk Assessment Guide, 2nd ed. (SARA; Kropp, Hart, Webster, & Eaves, 1995), a structured professional judgment risk assessment and management tool for IPV, by police officers in Sweden over a follow-up of 18 months. SARA risk assessments had significant predictive validity with respect to risk management recommendations made by police, as well as with recidivism as indexed by subsequent contacts with police. Risk management mediated the association between risk assessment and recidivism: High levels of intervention were associated with decreased recidivism in high risk cases, but with increased recidivism in low risk cases. The findings support the potential utility of police-based risk assessment and management of IPV, and in particular the belief that appropriately structured risk assessment and management decisions can prevent violence.     

Dialogic reverberations: police, domestic abuse, and the discontinuance of cases

This study investigated the social construction of domestic abuse by police officers, specifically in the context of arguments presented to the prosecutor for a decision on whether to proceed with or discontinue the case. Nineteen police files were examined with a particular focus on the MG3, the "Report to Crown Prosecutors for Charging Decision." Access to such sensitive material is usually denied to researchers; therefore, this study offers unusual insights into the treatment of victims and perpetrators of interpersonal violence by the police. Discourse analysis revealed three dominant speech genres: impartiality, credibility, and the "real" victim. These genres separately and in interaction served to construct domestic abuse cases in ways that did not support the victim's account. The "dialogic reverberations" of these findings are discussed and the implications of the work for research and practice are considered.
