The Report of the Committee on Ministers' Powers which appeared in 1932, was principally concerned with problems of subordinate legislation and formal administrative adjudication. Against a background of Dicey's views on parliamentary sovereignty and the Rule of Law, the Committee explored a variety of issues and made numerous proposals. In this article an attempt is made to consider why the Committee was appointed and what has happened since 1932. Particular reference is made to the Report of the Committee on Administrative Tribunals and Enquiries which appeared in 1957. Abstract. Deregulation became a major cross-national trend in the 1980s. Proponents of deregulation have included neoclassicists, pragmatists and certain analysts on the Left and Center-Left. Deregulation has a number of unintended or unforeseen consequences. A major issue is the development of new, market-oriented regulations and regulatory structures – the first category of 'reregulation'. Another is the cross-national knock-on effect of regulatory changes. And a third is the emergence of new forms of market stabilization and control, whether by the state or at the transnational level. A crucial feature of deregulation is the change in the wider pattern of state intervention from the 'welfare state' model to that of the 'competition state'. A number of competing explanations for deregulation can be identified – market explanations, institutional/technological explanations and political explanations – each of which has significant variants. These explanations can be seen to apply in the real world at four different levels: the 'global' level; that of various intermediary transnational political structures; the state level; and the level of 'self-regulation' of a neo-corporatist kind. 相似文献

Abstract. Re-analyzing a study of Garrett and Mitchell ('Globalization, government spending and taxation in the OECD', European Journal of Political Research 39(2) (2001): 145–177), this article addresses four potential sources of problems in panel data analyses with a lagged dependent variable and period and unit dummies (the de facto Beck-Katz standard). These are: absorption of cross-sectional variance by unit dummies, absorption of time-series variance by the lagged dependent variable and period dummies, mis-specification of the lag structure, and neglect of parameter slope heterogeneity. Based on this discussion, we suggest substantial changes of the estimation approach and the estimated model. Employing our preferred methodological stance, we demonstrate that Garrett and Mitchell's findings are not robust. Instead, we show that partisan politics and socioeconomic factors such as aging and unemployment as expected by theorists have a strong impact on the time-series and cross-sectional variance in government spending. 相似文献

Abstract. On the basis of data on the Dutch peace movement, we study the relationship between traditional organizations of political intermediation such as parties, unions and churches with a new social movement on the local level. After having argued for the relevance of the institutional context, the general structure of new social movements and the particular structure of the movement under consideration with regard to this relationship, we first present evidence confirming our claims that we are dealing with new social movement. Then we show that the relationships in question are quite elaborate confirming the hypothesis that political activity within traditional organizations and new social movements is to some extent cumulative. More generally, the results imply that the development of the peace movement and other new social movements in the Netherlands is not indicating a diminishing legitimacy of the Dutch political parties. 相似文献

The impacts of quarterly adult arrest rates on later male serious delinquency prevalence rates were investigated in Philadelphia police districts (N = 23) over several years using all male delinquents aged 10–15 years who were mandated to more than “straight” probation. An ecological deterrence model expects more arrests to lead to less delinquency later. A community justice or mass incarceration model, the ecological version of general strain theory, and an ecologized version of the procedural justice model, each anticipates more arrests lead to more delinquency later. Investigating quarterly lags from 3 to 24 months between adult arrests and later delinquency, the results showed a time‐dependent relationship. Models with short lags showed the negative relationship expected by ecological deterrence theory. Models with lags of about a year and a half showed the positive relationship expected by the other three theories. Indicators needed so future works can gauge the relative merits of each theoretical perspective more accurately are described. The spatial distributions of current and 1920s delinquency rates were compared. 相似文献
