Between Mendez and Brown: Gonzales v. Sheely (1951) and the Legal Campaign Against Segregation

On March 26, 1951, three years before the historic Brown decision, in Gonzales v. Sheeley ( 1951 ) , Judge Dave Ling of the United States District Court of Arizona ruled that the segregation of Mexican American students in a separate "Mexican School" was unconstitutional. In this article, we trace the legal arguments in Gonzales through two prior cases, Mendez v. Westminster (1946 ) and Delgado v. Bastrop (1948 ). We analyze how racialism, the social science critique of racism and legalism, shaped the arguments in the three cases. Our analysis suggests that Gonzales was a departure from Mendez and Delgado because it was the first case in which a court made an unqualified argument against segregation. The trajectory of the legal arguments across the three cases highlights how new cultural ideas about race were slowly incorporated into civil rights case law, a process that was also shaped by the institutional norms and practices of the legal system.     

Political legitimacy

These comments take issue with two aspects of the treatment of Rawls in On The People’s Terms. First, I criticize the characterization of Rawls as downplaying political liberties and focusing instead on social justice. Second, I take issue with the claim that Pettit provides a more robust conception of legitimacy than Rawls. The basis for this claim is that Rawls, along with others in the Kantian tradition, downplays the question of legitimacy by ‘going hypothetical’. Yet in common with Rawls, Pettit’s republican conception of legitimacy imposes a stringent test of legitimacy that many democratic regimes would not pass. This leads him to propose a weaker standard of ‘legitimizability’ that appears to involve the same kind of counterfactual judgment for which Rawls is criticized.

To do so, it compares two German parties that did not return to the Bundestag and two that did. In light of the ‘lessons' of previous cases in the Federal Republic, the essay considers the prospects of the Free Democratic Party (FDP) in the wake of its 2013 federal election defeat.     

K2 Toxicity: Fatal Case of Psychiatric Complications Following AM2201 Exposure

Limited forensic and clinical experience and the lack of confirmatory testing strategies for synthetic cannabinoids (SC) prevent adequate characterization of SC toxicity and the potential impact on public health. A statewide surveillance system identified a fatality involving a 23‐year‐old man found with a large stab wound to the neck following use of a SC product suspected of containing AM2201. Analytical testing for common SCs, SC metabolites, routine drugs of abuse, and over‐the‐counter medications was performed on heart blood obtained at autopsy. Additionally, assays were performed on the SC raw material and drug paraphernalia found on the decedent. High concentrations of AM2201 were detected in all samples. AM2201 metabolites were detected in postmortem blood. Other than a trace amount of JWH‐073 found in smoke residue, no other substances were detected. Psychiatric complications including self‐induced, lethal trauma can occur after the use of SC products.     

OBSTACLES TO SEEMINGLY SIMPLE REFORM: A CASE STUDY OF BAIL REFORM

This study involves analysis of the implementation of a new release on recognizance (ROR) policy governing misdemeanor cases in a small, mid- western county. The case study is interesting because the policy seems to be characterized by several factors that might lead to predictions of high compliance with policy intent. The findings, however, suggest that consid- erable slippage between intent and implementation occurred. It is argued that this slippage is the product of communication problems, the disposition of street-level implementors, and the failure to include implementors in decision making. These obstacles are then compounded by the lack of performance monitoring. The problems are viewed as interrelated and revolve around the top-down implementation strategy that failed to involve those responsible for implementation – the street-level implementors.     

The Offer Self-Image Questionnaire for adolescents: Psychometric properties and factor structure

The reliability and validity of the Offer Self-Image Questionnaire (OSIQ) for adolescents were investigated using data from an Australian sample of male and female school students, with an average age of 14.9 years (n=216). Reliability coefficients were high for all subscales except the Morals subscale. Results indicated significant correlations of the OSIQ subscales with Lang and Tisher's Children's Depression Scale of 1978 and small correlations with a measure of social desirability. A factor analysis yielded five interpretable oblique factors that support the concept of a multidimensional self-image. Identification of items contributing little to the subscale alphas, and not loading on the factors yielded by the factor analysis, highlights the need for further development and validation of the OSIQ. Implications for the development of the self-concept at adolescence are also discussed.Received Ph.D. from University of Queensland.
