Directive 2013/40/EU of the European Parliament and of the Council of 12 August 2013, on attacks against information systems, came into force on 3 September 2013, replacing Council Framework Decision 2005/222/JHA. It maintains existing offences and criminalizes new activities such as illegal interception and the usage of certain tools for committing offences. The offence that is the focus of this article – illegal access to information systems – is set out in Article 3. It represents a change from the wording of Art 2 (2) of the Framework Decision 2005/222/JHA in that under Art 3 of the Directive the incrimination of illegal access to information systems now depends upon whether such access infringes a security measure. This paper provides an overview of the impetus for the introduction of cybercrime laws and analysis of the key provisions of the Directive before exploring whether the wording of Art 3 is a sensible legislative approach. 相似文献

The aim of the present study was to examine the psychometric properties of the Barratt Impulsiveness Scale version 11 (BIS-11) among a forensic sample of incarcerated male juvenile offenders (N?=?221). Principal Component Analysis with Promax rotation revealed the expected 6-factor structure, but Confirmatory Factor Analysis of the 6-factor first-order and the 3-factor second-order factorial structures did not present sufficiently good fits. Despite that, the Portuguese adaptation of the BIS-11 demonstrated generally acceptable psychometric properties in terms of internal consistency, mean inter-item correlation, convergent validity, discriminant validity, and concurrent validity that justifies its use among the youth forensic population. Statistically significant associations were found with age of crime onset, conduct disorder, crime seriousness, alcohol use and drug use. 相似文献

This paper asks whether citizens judge public administration to be trustworthy using different criteria from other political institutions. Using survey data, we estimate ordered logistic and multivariate regressions to compare the determinants of trust in six different political-administrative institutions. Findings show that social trust, political interest, as well as other individual characteristics, have very similar effects on trust regardless of the institution. The evidence shows that people who are older and more educated, interested in politics, and employed in the public sector, are only slightly more likely to make some sort of distinction. Implications for non-discriminant judgement mechanisms are discussed. 相似文献

Over the past decade, power dynamics within the South Atlantic region have undergone significant changes. While the area has historically been dominated by North–South ties, both in terms of material flows and with respect to political influence, more recently there has been a surge in cooperation between developing countries within this space. As trade, investment and other forms of exchange and dialogue increase among actors from within the region (notably between South America and Africa) and with states located outside the region, the BRICS countries become more relevant to the South Atlantic. Individually, they have become relevant players in the South Atlantic's economic, political and security dimensions. Collectively, as inter-BRICS flows and political coordination intensify, new configurations of cooperation emerge within the South Atlantic. These initiatives suggest that rising powers are contributing towards making the South Atlantic – long dominated by North–South ties – a space where South–South cooperation and norms predominate. 相似文献

Although mainstream models of accountability assume that the election date is exogenously fixed, in almost any parliamentary democracy governments may choose it. This article proposes a theory of the strategic timing of elections that highlights the role of the economy and the type of government. First, incumbents will call early elections when the economy is growing and inflation rates are low. Nevertheless, coalition and majority governments will fall short of the ability and the incentives to do so, respectively. As a result, the effect of the state of the economy on the opportunistic dissolution of the parliament will be stronger when there is only one party in government, and it lacks a majority in the lower house. School victimization is associated with negative social-emotional outcomes and risky behaviors. Most studies have provided definitions and measures of victimization, depicting a limited characterization of victimization in schools. More nuanced analyses of school victimization are needed to assess the heterogeneous pattern of victimization in schools. The current study explored distinct victimization configurations in a diverse sample of 418,483 middle and high school students in California, utilizing latent class analyses to account for type and frequency of victimization. The results uncover four classes of victimization, including frequent verbal, physical, and sexual victimization; occasional verbal and physical victimization; verbal and sexual victimization; and no victimization. Older age was associated with a lower likelihood of frequent verbal, sexual, and physical victimization and African American youth were more likely to be classified in this class. Females were more likely to be in the verbal and sexual victimization class than males. 相似文献

This article presents an experimental analysis of the combination of different regions of the human face on various forensic scenarios to generate scientific knowledge useful for the forensic experts. Three scenarios of interest at different distances are considered comparing mugshot and CCTV face images using MORPH and SC face databases. One of the main findings is that inner facial regions combine better in mugshot and close CCTV scenarios and outer facial regions combine better in far CCTV scenarios. This means, that depending of the acquisition distance, the discriminative power of the facial regions change, having in some cases better performance than the full face. This effect can be exploited by considering the fusion of facial regions which results in a very significant improvement of the discriminative performance compared to just using the full face. 相似文献
