The article addresses the argument, put forward by Lernestedt, that the proprietor of the ‘criminal-law conflict’ is the community (or the community and the offender) and discusses his proposed theoretical model of criminal law trial. I raise questions regarding the legitimacy of such a model, focusing on four counts. Firstly, I assert that his assumptions about the state the individual and the old/new versions of criminal law theory are society-dependent. Secondly, I address some problems with the concept of community and particularly with the proposed conception of community, which seems to mostly exclude the offender. Thirdly, I question the need for (or added value of) such a proposed conceptual involvement of the community as an actor in the criminal law process and theory. Lastly, some potential problems with the idea of the victim as a mere “representative of us” are mentioned, including the possibly undesirable demands and limitations on the victim’s agency and issues of respect for the victim’s individuality.  相似文献

We explore agencification and corporatization in the Norwegian central government. While these types of organizational change have often been linked to the NPM and post-NPM doctrines of recent decades, we will extend our analysis back to the post-World War II period. The empirical data are drawn from the Norwegian State Administration Database. The main focus will be on changes along the vertical dimension, i.e., conversions of ministerial units into state agencies and from state agencies to state-owned companies, or in the other direction. A main question is the organizational dynamics of agencification and corporatization. Why have the structure and organization of government changed, how and to what degree do the pattern of change reflect global trends in NPM and post-NPM reforms, and is the central government subject to the politics of structural choice. Moreover, what is the importance of national administrative doctrines, party constellations in government, and deliberate actions of administrative policy-makers?  相似文献

This article discusses artists’ work in performing arts institutions in Norway. Many scholars describe Nordic performing arts institutions as slow-moving and heavy “art factories,” where artistic creativity is almost suffocated within bureaucratic “prisons.” The general problem that we raise in the article is whether this pessimistic picture of the relation between state control, market influence, and artistic work is relevant for studying the performing arts today. The study is primarily based upon twenty-seven qualitative interviews with informants in an institutional theatre and a symphony orchestra. We conclude that the actors in the Theatre are trapped—not so much within “a bureaucratic iron cage”—but rather within “an iron cage of charismatic leadership,” while the musicians in the Orchestra enjoy the relative freedom and democratic power of a rather soft bureaucratic organization.  相似文献

In this article, the authors discuss "whole-of-government" initiatives as a reaction to the negative effects of New Public Management reforms such as structural devolution, "single-purpose organizations," and performance management but also as a reaction to a more insecure world. The authors examine what is meant by a "whole-of-government" approach and explore how this concept might be interpreted in analytical terms. The structural approach is contrasted with a cultural perspective and a myth-based perspective. Administrative policies and practices may evolve and change slowly and incrementally or they may be transformed intentionally. Intentional efforts to change administrative policy by transforming the structure, processes, or personnel of public sector organizations define an active administrative policy. Ideally, an active administrative policy takes as given that the organizational form to be used is open to choice, that administrative goals are clear, that a tight coupling exists between ends and means, that different organizational forms have different effects, and that there are criteria that may be used to assess those effects. This article focuses on the fulfilment of these preconditions in the three national contexts – Norway, Sweden and the United States of America – in order to determine the relevance of a transformative perspective for understanding the process of administrative change. We examine what impact constraints like polity features, historical-institutional traditions and external pressure, particularly through popular international administrative doctrines like New Public Management ideas and financial crises, have on the possibilities to enhance an active national administrative policy.  相似文献

The main purpose of this article is to argue the importance of combining several approaches in studies of communist parties: socio-economic structures, competitive relations to other left wing parties, organizational implantation, and the role of political tradition. The present ecological analysis will particularly emphasize the organizational approach and the importance of political tradition. In keeping with Allardt's and Lipset's theories, socio-economic structure seemed to a great extent to be a necessary condition for communist strength in this period. Both significant employment in industry and/or forestry and a strong social democratic party turned out to be necessary conditions for communist strength, but only when we analysed the ‘historical’ and organizational dimensions in more detail were we able to determine more accurately the areas of strong electoral support of the Norwegian Communist Party.  相似文献

In this article, the authors describe the changes that have taken place in the Norwegian civil service over the past 30 years, focusing on demographic changes in education and gender and on changes in civil servants' tasks, attitudes, and contact patterns. The changes are analyzed using tenure, structural, and demographic perspectives. The unique empirical database is provided by surveys conducted every 10 years of civil servants in the ministries since 1976. The main empirical findings are that there has been a combination of robustness and change. The findings show little support for the generational version of a tenure perspective, meaning that civil servants are not living in the past. The structural perspective, illustrated by the importance of formal position, best explains the variations in civil servants' contact patterns and attitudes, followed by the career version of a tenure perspective. Demography, as represented by different educational backgrounds and gender, also has an effect.  相似文献
