物权法上的善意取得制度一般只适用于体现纯财产利益的财产,人格财产作为一类兼具人格利益和财产利益的特殊财产具有独特的法律属性,从充分地保护人格财产所彰显的人格利益和精神价值考虑,其不能适用善意取得制度。但人格财产若因各种原因丧失了人格利益或者人格利益已降低为次要利益,则其与普通财产无异,可在符合善意取得各项要件时予以适用。 相似文献

The application of vacuum metal deposition before scanning Kelvin probe visualization of fingerprints is investigated. The potential contrast between fingerprint ridges and furrows is maximized by the use of silver deposition for non‐noble metals and gold–zinc deposition for noble metals. The higher susceptibility of eccrine fingerprints to vacuum metal overdeposition is confirmed. Additionally, fingerprints are best developed individually and by building the metal deposition slowly to protect against overdevelopment and variation in the rate of metal condensation. The progress of the metal deposition can be monitored using the scanning Kelvin probe by reference to the change in potential and continuity of the new potential on the surface. The use of acetic acid solution for the recovery of overVMD‐developed samples is shown not to be useful. Applying the metal deposition has the additional prospect of increasing surface conductivity and homogeneity and both can aid fingerprint visualization using the scanning Kelvin probe. 相似文献

We assess the effects of real peso devaluations, as well as the effects of GATT and NAFTA, on Mexico's in-payments and out-payments with the United States for 102 industries. We find that relatively few trade flows are sensitive to changes in the real exchange rate, probably due to production-sharing and intra-industry trade, but devaluations affect Mexican imports more than exports. Trade liberalisation has had a larger impact, particularly on imports of intermediate goods and exports of certain manufactures. Many affected export industries are ones that have previously been shown to have economies of scale. 相似文献

AbstractChina’s engagement with global capitalism is driven by the emergence of a statist and private transnational capitalist class. Nevertheless, aspects of China’s foreign policy from the Maoist period still echo today. Consequently, elements of third world solidarity and opposition to Western domination continue to exist as China’s past is redefined to further its transnational strategies in Latin America and the US. The main Chinese investments in South America have been in energy and infrastructure among the left lead countries of the Pink Tide. In the US, Chinese capital has grown despite heated political rhetoric. Many environmental problems are transnational in their causes, consequences, and/or solutions. The increasing pace of global environmental destruction suggests that research on policies to address these problems has proved to be inadequate to the task. One possible way to enhance our understanding of global environmental politics and policy is to look more carefully at what goes on between and across the international and domestic aspects of it: to look at environmental foreign policy. This article describes foreign policy in the context of global environmental politics and discusses the potential utility of foreign policy analysis to help scholars and policy makers to better explore, comprehend, and possibly mitigate the human impact on the environment. Mr Sheng Wang demonstrated his perception of Mercedes‐Benz's unfair treatment and insensitivity to Chinese buyers by having his Mercedes sports coupe towed by a water buffalo through his Chinese hometown, Wuhan. But he did not stop there. Next, he ordered workers, specifically hired for this purpose, to pound the car with sledge hammers and sticks until the exterior was completely disfigured. Journalists love the story's inherent drama, and in subsequent days, media reports showed images of the car being towed and ultimately smashed. The event created strong public awareness about both Mr Wang's dissatisfaction about the treatment he received from Mercedes‐Benz and the subsequent Mercedes‐Benz's management reactions triggered by the event. In our paper, we explore this case in more detail, highlighting the crucial role of brand fairness in managing brands in China. Although brand managers implicitly emphasize the importance of fairness in branding strategies, brand management emphasizing fairness is an underdeveloped research concept. Our paper provides an understanding of theories and concepts of brand (un)fairness and brand fairness management illustrated by what we refer to as the Mercedes‐Benz case. We identify three dimensions of Brand Fairness Management: prevention, procedures, and outcomes. This framework will assist brand managers in China in developing successful brand fairness strategies and management programs. We posit that implementing these branding practices will increase the likelihood that consumers perceive the brand in question as fair, leading to an increase in loyalty and positive word‐of‐mouth.
