Prospects for the ‘rule of law’ in the present are shaped by historical experiences of law by elite and non‐elite groups in the past. In this article I explore changing conceptions and practices of‘rights’and‘justice’as expressed in the legal and administrative encounters between indigenous people and state officials during the regime of Jorge Ubico (1931–1944). The extension of the state's coercive and administrative apparatus to remote rural areas, new legislation and changes in public administration transformed relations between working people, coffee fmqueros and the state in Guatemala. This implied new obligations and exactions for Mayans, but also provided them with new opportunities to contest and negotiate their conditions. Indigenous people strategically engaged with the law to contest the terms of their domination by elite actors and to mediate conflicts between themselves. As state ideologies of‘moral behaviour’led to increasing regulation of the private sphere, this was particularly important in the case of conflicts over gendered rights and obligations. Although formally excluded from the category of citizens, indigenous people used the official language and discourse of citizenship to further their claims, in turn reshaping Guatemalan nation‐state.  相似文献

While the Israeli-constructed wall in the occupied West Bank seemingly signifies a shift to a policy of separation, every year thousands of West Bank Palestinians legally and illegally cross its bounds into Israel for work. In this article, I explore the varying regimes of (il)legality and (im)mobility that have accompanied the construction of the Israel–West Bank separation wall, which decisively impact the lives of Palestinians who work in Israel. The peculiar separation legislated by the wall, which is often treated as a de facto ‘border’, obscures the ways in which it facilitates continued Israeli territorial expansion and deepens the subjugation of the Palestinian population. As a border, the separation wall functions more as a colonial frontier, the asymmetry of which has powerful implications for the border crossings of documented and undocumented workers, as well as their respective experiences of illegality inside the West Bank and in Israel. It is in the context of West Banker Palestinians who work in Israel, I argue, that the doctrine of separation embodied in the wall is exposed as not only deceptive, but also obfuscating of the relation of asymmetrical dependence between the two entities.  相似文献

Critical social scientific research holds that credit–debt is a principal economic and governing relation in contemporary economy and society, but largely neglects money’s role in indebted life. Drawing on qualitative research in the payday loan market in the United Kingdom, the paper shows that borrowers typically relate to loans in monetary rather than financial terms and incorporate them into practices of payment, spending and online banking. To analyse how indebted life is variously experienced and enacted through money, the concept of money culture is developed to refer to money’s culture, money’s meanings and money’s affects. Borrowers enter into and negotiate payday loans through a digitally mediated money culture that both mobilizes and runs counter to money’s powerful fictions as circulating universal equivalent and calculative means of account.  相似文献

ABSTRACT

This article presents a framework that extends the discussion of translational criminology and the dynamic process of translating research to practice. The goal is to provide an explicit dissection of the translation process into four phases to help outline a structured way of thinking about how to incorporate research into police practice. The four-phases include: Phase I: ‘Does it Work?’ Research and Evaluation; Phase II: ‘What Works?’ Synthesis and Dissemination; Phase III: ‘How to Make it Work?’ Implementation and Evaluation; and Phase IV: ‘Make it Work!’ Institutionalization and Sustainability. The process is founded in implementation science and the ‘Knowledge to Action’ model (KTA) used in the medical and public health fields, as well as current translation activities for policing, and the authors’ experience as practitioners, researchers, and ‘translators’ over the last 25 years. It is the hope that parsing out four distinct phases for the translation of research to practice will assist researchers and police leaders to identify and fill gaps in current and future translation activities.  相似文献

ABSTRACT

Bullying persists as a concern in schools, including the question of why some children bully. One idea differentiating bullying roles (e.g., bully, victim, bully-victim) is that some individuals are morally disengaged, or able to disconnect their moral understanding and behavior. The present study examined types of bullying involvement and moral disengagement. To address the methodological debate within the bullying literature, the present study used latent analysis. The findings revealed that bullying and victimization behaviors vary by degree of involvement. The present study found that moral disengagement was related to students’ degree of participation in bullying; students in the bully-victim class had the highest levels of moral disengagement, followed by students in the victim class, social victim class, and outsider class. Further research should explore moral engagement as a strategy to enhance anti-bullying efforts.  相似文献
