States, administrative agencies, hospitals, and physicians have placed significant limitations on the availability of elective sterilization (absolute prohibitions, requirements of spousal consent, age-parity requirements, and marital requirements). These limitations have presented obstacles for individuals seeking sterilization as a means of contraception. Analysis reveals that an individual should have a right to sterilization. However, to obtain a sterilization the individual must either comply with statutory requirements where they exist or challenge their constitutionality. If the restriction is the product of "state action," it may be challenged in the courts. Only hospitals of a "public" character, however, are subject to the constitutional mandates. If the individual is limited geographically, financially or otherwise, to a "private" hospital, he will not be able effectively to exercise his right to be sterilized.  相似文献

We sampled a total of 411 participants and randomly assigned them one of three brief trial vignettes that contained either no-polygraph evidence, evidence of a passed polygraph test, or evidence of a failed polygraph test. Participants rendered guilt judgments and answered a series of questions concerning the trial in particular, and polygraph tests in general. Similar to previous studies on the impact of polygraph evidence on jurors' guilt judgments, this sample of jury-eligible adults indicated that they did not find polygraph test evidence to be persuasive. Moreover, it mattered little to participants whether the results indicated the defendant passed a polygraph test, or that he failed a polygraph test. However, when our findings are compared to those of previous surveys involving experts in the field of psychophysiology, they differ in a number of important respects. The implications for decisions regarding admissibility (e.g., U.S. v. Alexander, 1975 and U.S. v. Scheffer, 1998) are discussed.  相似文献

This retrospective study investigates the impact on women's functioning of recounting during their therapy the graphic details of sexual abuse they had experienced in childhood. Fifty-nine participants residing in Southern Ontario were divided into two groups: those who spent more time (N=19) versus less time (N=40) in therapy recounting graphic abuse details. Results revealed that the group who had spent more time recounting abuse memories: (a) had mean functioning scores that were significantly lower before and during therapy, but that did not significantly differ after therapy; (b) recovered more memories of abuse during therapy, and (c) were more likely to have participated in hypnosis, and to report having been encouraged to remember details of abuse. Participants rated as most therapeutic those approaches that assisted them to increase their understanding of the abuse. Strategies related to acceptance, understanding, and making meaning were most important in promoting healing.  相似文献

Abstract: Limited information is available on racial offending patterns of sexual homicide offenders (SHOs). This study used a 30‐year U.S. Supplementary Homicide Reports sample of SHOs arrested in single‐victim situations (N = 3745). The analysis strength was used to determine whether the findings yielded meaningful patterns for offender profiling. Several important findings emerged for the juvenile offenders. Juvenile White SHOs were likely to target victims with whom they shared a mutual relationship. In contrast, Black juveniles were equally likely to murder strangers and those with whom they had prior and familial relationships. Notably, no juvenile Black SHOs were arrested for murdering intimate partners. Juvenile White SHOs were twice as likely to use edged weapons as their Black counterparts. Black juveniles, conversely, were more likely than White juveniles to use personal weapons. Beyond these findings, known victim–offender relationships and weapon used may not have significant utility for investigators in identifying the SHO race, even after controlling for offender age. As part of the ‘accountability movement’ in juvenile justice, policy-makers, funding agencies, and the general public have called for greater accountability from agencies and organizations involved with youthful offenders. Within this context, performance measurement and monitoring, and use of evidence-based programs and practices, have emerged as recommended aspects of juvenile justice system operations nationwide. Little is known empirically, however, about the actual performance of juvenile justice systems or the real changes brought by contemporary reforms, and theory and research on the implementation and sustainability of evidence-based approaches have been slow to emerge. This paper will review the key aspects of the modern accountability movement in juvenile justice, and then discuss a recently proposed theory that may be useful in future examinations of juvenile justice system improvement efforts.
