This paper explores the impact of precarious employment relationships on health outcomes. It uses a novel framework, "Employment Strain" to describe the characteristics of different employment relationships and how they impact health outcomes. It uses interview data and comments provided on a survey to explore these issues. The paper begins by exploring if the health effects reported by mid-career individuals in precarious employment are different from those of younger and older workers. Finding limited evidence to support this hypothesis, the paper goes on to explore in detail the conditions under which precarious employment does increase stress and tension and impact health outcomes. It concludes that a combination of an individual's desire for more permanent employment, the expectation that permanent employment will be found, and the support individuals receive from various sources are critical to understanding the health effects of precarious employment.  相似文献

Seit 1914 glaubt man mit Hugo Sinzheimer, Vater des deutschen Arbeitsrechts, dass der Arbeitnehmerbegriff für alle Dienstleistenden gleich ist. Nach hM ist das entscheidende Kriterium für die Arbeitnehmereigenschaft die pers?nliche Abh?ngigkeit. Es kommt dabei auf arbeitsorganisatorische Bindungen des Dienstleistenden an. Die Judikatur stellt diese Bindungen aber oft in einen Kontext, den der Autor Referenzrahmen nennen m?chte. Die Referenzrahmen sind: die Natur der T?tigkeit, der Nicht-Vertragspartner und der typische Arbeitnehmer. Gefragt wird nun, wie sich die Bindungen zu diesen Referenzrahmen verhalten. Je nach Ergebnis soll die Bindung für die pers?nliche Abh?ngigkeit relevant sein oder nicht. Der Autor m?chte hier das Argument von der Natur der T?tigkeit in den Vordergrund stellen. Dieses Argument führt je nach Art der ausgeübten T?tigkeit zu unterschiedlichen Anforderungen an die Arbeitnehmereigenschaft und somit zur Gef?hrdung der dogmatischen Erkenntnisse von Sinzheimer. Gleichzeitig führt das Argument zu einer deutlichen Verengung des Arbeitnehmerbegriffs. Die Untersuchung wird zeigen, dass das Argument dogmatisch und ?konomisch verfehlt ist und daher aufgegeben werden sollte.  相似文献

Framed in the Justice and Home Affairs external dimension (JHAE) literature that argues that the European Union's (EU) internal security has become an objective of European foreign policy, this article offers an analysis of the institutionalization of border management in the Mediterranean. Investigating the role of Frontex, the European border management agency, this article reveals that border management in the Mediterranean is a fragmented policy that presents internal and external challenges. First, at an internal level, border management remains a sensitive issue where the principles of burden sharing and solidarity between EU member states are difficult to operationalize. Second, at an external level, effective border management is dependent on cooperation with EU's neighbours, as the Spanish-Moroccan case demonstrates. Lastly, along with these internal and external challenges, border management raises some crucial issues about the opportunity of externalizing surveillance technologies to authoritarian regimes.  相似文献

Entomological succession and trophic roles of arthropods associated with different stages of carcass decomposition were studied to estimate the post-mortem submersion interval in two freshwater ecosystems in the Colombian Andes, at an altitude of 2614 m. Pig carcasses were employed as models placed 68 m apart, one in a stream (lotic) and another in an artificial lake (lentic). Decomposition time to skeletal remains was 74 days in the lake and 80 days in the stream. Six phases of decomposition were established: submerged fresh, early floating, floating decay, bloated deterioration, floating remains and sunken remains. A total of 18,832 organisms associated with the carcasses were collected: 11,487 in the lake (four orders, 19 families and 33 species) and 7345 in the stream (eight orders, 15 families and 25 species). Organisms were classified in the following ecological categories: shredders, collectors, predators, necrophagous, sarcosaprophagous and opportunists. Physical and chemical properties of the habitats, such as water temperature, CO(2) and conductivity, varied according to rainfall. In the lake, shredders (Coleoptera: Tropisternus sp. and Berosus sp.) and collectors (Diptera: Chironomus sp.) were found to be associated with submerged phases. Predators (Odonata) were only present during the first phases. Coleoptera (Dytiscidae) were found during floating decay and bloated deterioration stages. In the stream, shredders (Hyalella sp.) and collectors (Simulium sp.) were found during all stages, whereas the predator Oxelytrum discicolle was found exclusively during the floating stages, during which body temperature increased in a fashion similar to active decay in terrestrial environments.  相似文献

Admission into mental health courts is based on a complicated and often variable decision-making process that involves multiple parties representing different expertise and interests. To the extent that eligibility criteria of mental health courts are more suggestive than deterministic, selection bias can be expected. Very little research has focused on the selection processes underpinning problem-solving courts even though such processes may dominate the performance of these interventions. This article describes a qualitative study designed to deconstruct the selection and admission processes of mental health courts. In this article, we describe a multi-stage, complex process for screening and admitting clients into mental health courts. The selection filtering model that is described has three eligibility screening stages: initial, assessment, and evaluation. The results of this study suggest that clients selected by mental health courts are shaped by the formal and informal selection criteria, as well as by the local treatment system.  相似文献

The purpose of this paper is to cast a vision for the next generation of behavioral health and criminal justice interventions for persons with serious mental illnesses in the criminal justice system. The limitations of first generation interventions, including their primary focus on mental health treatment connection, are discussed. A person–place framework for understanding the complex factors that contribute to criminal justice involvement for this population is presented. We discuss practice and research recommendations for building more effective interventions to address both criminal justice and mental health outcomes.  相似文献

Policy makers in the United States and the United Kingdom recognize that mentally disordered offenders present special challenges to law enforcement, mental health, and social service systems, as well as the community. Although various policy initiatives have advanced over the past twenty years to improve the management of mentally disordered offenders, mental health policy has chronically failed in both countries. Because safety concerns have emerged as the mental health system has been "deinstitutionalized," debate is growing about whether the community-care approach works-for the community. This study argues that mental health policy fails because policy makers focus on the wrong risks and design policies that manage these risks in ways that increase the possibility of adverse clinical and economic outcomes. The argument made here uses the case of persons with severe mental illness in the United Kingdom as an example of the complex relationship between risk and policy making in democratic governance. Emphasis is on the nature of risk in mental health policy and how government responds to policy and political risks. Mental health policy in Britain is then analyzed in terms of its response to and management of risks. Mental health policy has historically mismanaged the risk issue in the United Kingdom and as such has set in motion the growing community-care backlash. The path to a better outcome lies in the responsible management of the right risks. Lessons from the United Kingdom experience can be usefully applied to mental health issues in many industrial democracies.  相似文献
