The contrast between legal and clinical perceptions of reality, characterized as discrete versus continuous in nature, generates dilemmas for both professions. Clinical documentation of the bites, correlation with entomological studies, and submission of evidence at trial are reported. Insects that have a discrete geographic distribution and leave bites of a characteristic nature may have important forensic science implications.     

Judicial Perspectives on Family Drug Treatment Courts

Family Drug Treatment Courts are a specialized calendar or docket that operates within the juvenile dependency court. These courts provide the setting for a collaborative effort by the court and all the participants in the child protection system to come together in a non‐adversarial setting to determine the individual treatment needs of substance‐abusing parents whose children are under the jurisdiction of the dependency court. This article is intended to give judges and others a judicial perspective on FDTCs, and to offer some assistance for those who are operating or who are considering creating one.     

Guarding against Nanotort Liabilities

Recent headlines comparing the health risks of nanotechnology to those of asbestos have appeared in newspapers throughout the country and on the Internet. Governmental agencies and standard-setting organizations have begun considering and actually adopting requirements to protect against such purported risks. The plaintiffs’ bar and potential plaintiffs have surely taken note. There is every reason to believe that the era of mass tort and class actions related to nanotechnology—“nanotorts” for short—is rapidly approaching. This article examines what nanotort claims might look like, the role that regulations and industry practices may play in such lawsuits, potential defenses to those claims, and what nanotech companies can do now to guard against future nanotort liabilities.
