In this paper, I reassess the co‐decision legislative procedure introduced by the Maastricht Treaty on European Union. Specifically, I examine the dispute as to whether co‐decision enhanced or diminished the European Parliament's influence over EU law making. Employing a combination of formal analysis of the different stages of the procedure and evidence from its actual operation, I argue that Garrett and Tsebelis’ claim that co‐decision reduces Parliament's legislative powers is both theoretically and empirically unsupported. The implications for the Parliament's position within European politics are evaluated in the conclusion. 相似文献

This article examines the public legitimacy of the National Assembly for Wales. Both the Assembly and the broader system of devolved government for Wales initially enjoyed very limited public support. It is shown that support for devolution in general has risen substantially, while some elements of public attitudes towards the Assembly itself now appear distinctly positive. However, it is also demonstrated that public legitimacy, defined as ‘diffuse support’ for the Assembly, remains limited. The article then examines what factors explain levels of diffuse support for the National Assembly. It is found that variation in such support is best accounted for by factors associated with ‘non-material consequentialism’: perceptions of the impact of the Assembly on the process of government. The conclusion assesses the implications of the findings for the National Assembly, as well as for the study of devolution and political institutions more generally. 相似文献

When Malaysia came to independence, considerable powers, particularly in the natural resources sector, were devolved on the rulers of the states of East Malaysia, Sabah and Sarawak. The subsequent deforestation, which benefitted the logging companies (and the politicians) was hard to reconcile with the interests of the indigenous peoples. Their plight was projected internationally by a Swiss activist, Bruno Manser, who lived with the Penan people for several years. But the resulting expressions of international concern over the rate of deforestation from, for example Al Gore and Prince Charles, have received short shrift from the government of Malaysia. Sarawak reputedly continues to have among the highest rates of forest destruction in the world. 相似文献

This article assesses the nature and extent of negative advertising on the Internet in the 1996 U.S. Senate races. As a benchmark for comparison, the use of negative campaigning in other media is outlined. In the aggregate, the Internet is a medium disproportionately characterized by positive campaigning. On the other hand, the candidates with negative campaigning used it a lot. In exploring the rhetoric of negative campaigning, a theoretical distinction between superficially comparative and engagingly comparative is offered and applied to 1996 campaign sites. The promise of sociolegal research varies for different constituencies. For some legal scholars it has been a promise of sustained commitment to moral and political critique of law and to theoretical and empirical analysis of law's social consequences and origins. To continue to deliver on that promise today, sociolegal studies should develop theory in new forms emphasizing the variety of forms of regulation and the moral foundations on which that regulation ultimately depends. It should demonstrate and explore law's roles in the routine structuring of all aspects of social life and its changing character as it faces the challenge of regulating relations of community not bounded solely by the jurisdictional reach of nation states. 相似文献
