“银河号”事件的国际法问题

<正> 一、"银河号"事件的经过1993年7月下旬,美国政府根据错误的情报,指责中国货轮"银河号"载有运往伊朗的化学武器前体硫二甘醇和亚硫酰氯,并从8月2日起出动军舰和军用飞机,对该轮进行跟踪、监视和骚扰。8月3日"银河号"在波斯湾公海抛锚,同日,美国无理要求中国政府命令"银河号"返回出发港或由美方登船检查,同时向该货轮预计停靠港口的所属国施加影响,使其拒绝该轮进港。对美方的指责,中方经过认真调查后早在8月4日就向美方作了澄清,明确指出,"银河号"根本没有装载所说的化学品,并提出由第三国核查的建议。至此,事情本应告一段落。但是美国仍然置国际法于不顾,顽固地坚持其原有立场。8月7日中国外交部向美国提出严重抗议。由于美国继续践踏公海航行自由,"银河号"的正常业务根本无法进行,被迫在公海上漂泊达二十余天。

<正> "同一认定"理论是犯罪侦查学中十分重要的组成部分,一直受到广泛的重视.现在已有诸多文章论述了这个问题,它们对推动该理论的发展无疑起过积极的作用,但与此同时也带来一些模糊不清的认识.本文拟就其中两种认识谈点看法,以供大家共同探讨. 一、同一认定与"同一鉴定" 最近,有的同志提出要"为鉴定中的同一鉴定正名"似乎想用"同一鉴定"来代替同一认定.对其所谓的"同一鉴定"作出如下表达:"侦查部门指派、聘请有专门知识的人运用专门技术手段鉴别和确定犯罪造型体在发生质变前的相对稳定阶段,在总的方面、在特性方面是否仍然是它自己本身的活动."细细
