Providing justice and reconciliation: The criminal tribunals for Sierra Leone and Cambodia

The Special Court for Sierra Leone (SCSL) and the Extraordinary Chambers for Cambodia (ECC) represent a departure from the model established by the International Criminal Tribunal for the former Yygoslavia (ICTY) and the International Criminal Tribunal for Rwanda (ICTR). The SCSL and the ECC have often been referred to as “mixed” or “hybrid” tribunals in which there are significant domestic and international components. The tribunals include a combination of domestic and international judges, utilize domestic and international laws and are administered by a prosecutorial team composed of domestic and international lawyers. Many of these institutional changes have been brought about because of criticisms of the ICTY and the ICTR. The fundamental question of this article is whether these mixed tribunals are a more effective mechanism for providing justice and reconciliation than purely international solutions. This is an important question because both the international community and states are moving in the direction of mixed tribunals.

Judicial Capacity Building in Bosnia and Herzegovina: Understanding Legal Reform Beyond the Completion Strategy of the ICTY

This article examines how international institutions serve to diffuse human rights norms and create judicial capacity building in post-conflict societies. Specifically, we examine how the International Criminal Tribunal for the former Yugoslavia (ICTY) and the Office of the High Representative have influenced the reform of domestic courts in Bosnia and Herzegovina (BiH). We place these reforms within the broader debate over restructuring the complex system of government in BiH. Since 2005, domestic courts in BiH have had jurisdiction over the following: (1) Cases which were initially under the jurisdiction of the domestic courts but remanded to the ICTY and recently returned to BiH. (2) Cases which originated at the ICTY and have been transferred to the State Court, and (3) new cases which originated and remained in the domestic court system. We find that while human rights norms have been incorporated into the new legal code, the diffusion of these human rights norms has been inadequate because of the lack of judicial capacity building. While some courts in the capital enjoy significant resources, the vast majority of cases will be tried at provincial courts which are under-funded and unable to prosecute the significant number of cases. Moreover, the government structure of BiH has had a decidedly negative impact on the prosecution of these cases. Ultimately, the rule of law requires consistency of approach and funding to protect human rights throughout the state.

From semi-presidentialism to parliamentarism: Regime change and presidential power in Moldova

This article examines Moldova's constitutional change in 2000 from a semi-presidential to a parliamentary regime and analyses what the Moldovan case tells us about the nature of executive power. One of the interesting issues that this case raises is whether our definition of regime really captures the locus of political power. While Moldova has evolved from a semi-presidential to a parliamentary regime, the president is more powerful under the current regime than previous presidents were in a semi-presidential regime. The consolidation of the president's party in the parliament explains the concentration of executive power more than constitutional prerogatives.     

The politicization of education: Identity formation in Moldova and Transnistria

This article examines how education, linguistic and citizenship policies have influenced the development of Moldovan identity and relations with the breakaway region of Transnistria. The article explores the influence of three specific education policies (Russian language instruction, an integrated history course and Romanian language school closures in Transnistria) on the debate concerning Moldovan identity and ultimately Moldovan statehood. The Romanian language school closures in Transnistria demonstrate that education is not only an important agent of identity formation, but also that such crude political tactics as school closures ultimately affect other education policies, reinforce negative stereotypes and make meaningful dialogue impossible. The larger issue than the school closures in Transnistria is whether devolution of authority on issues such as education policy is possible no matter how autonomy is granted.     

The Role of Competition in Best Value: How Far Does it Differ from CCT?

This article investigates the role of ‘competition’ within Best Value (BV) and compares it with that of Compulsory Competitive Tendering (CCT). Utilising results of a survey of BV lead officers, the article reveals that ‘competition’ is not being used as widely as may have been expected. However, in terms of outcomes, services subject to BV seem to be at least as likely to be provided externally as would have been the case under CCT. Further analysis also considers the impact that party political control and service type have on the use and outcomes of competition.     

Government,corporate or social power? The internet as a tool in the struggle for dominance in public policy

This paper sets out to demonstrate to corporations the need to monitor closely and to respond genuinely to public opinion. It predicts a rise in the power of citizens and a government response to that power that will include regulation to protect social and environmental interests. The paper gives an overview of the ways in which the economic sector, embodied in corporations, has risen to and maintained a position of dominance both within nation states and globally. It provides a model that illustrates the power relationship between corporations, governments and the public, noting in particular that the fundamental key to corporate dominance is the positioning of the public as consumers. Using the framework of legitimation, the paper then demonstrates and theorises the rise of opposition to the dominant order and the corporate and government responses to such opposition. It is proposed that these responses may be insufficient to maintain corporate dominance and that a new model is likely to gain ascendance. In this new model the public make a shift from consumers to citizens in order to reassert their role in governance. Internet sites of activist groups are examined in order to determine the ways in which the sites are used as a tool to facilitate a shift towards the second model.
