The question - ought Britain to have a written, more properly, a codified constitution - is perhaps wrongly put. The real question ought to be - why should Britain not have such a constitution… She is, after all, one of just three democracies without one.
There are two reasons why Britain has lacked a constitution. The first is that, historically, Britain never had a constitutional moment; the second is the doctrine of parliamentary sovereignty. Today, however, Britain finds herself engaged in the process of gradually converting an uncodified constitution into a codified one. There is undoubtedly a case in principle for enacting a constitution, but perhaps it ought to wait until the process is completed.
There is, moreover, a tension between two types of codified constitution - a lawyer's constitution which would be long and highly detailed, and a people's constitution which would be short, but, inevitably, broadly-worded, and therefore open to interpretation by the courts.  相似文献

This article analyses how political parties frame European integration, and gauges the consistency of their argumentation. Over the course of investigation, one can see how actors' positions are justified, and how the European Union is perceived (i.e., what forces give rise to Euroscepticism and Europeanism). It is argued here that the parties' framing of issues depends on the interests they traditionally defend at the national level, their general positions on European integration, and whether or not they belong to the established political actors in their respective countries. The coding approach enables the relation of frames to actors and positions, moving beyond the techniques employed by existing studies that analyse the media presentation of European integration. Sophisticated frame categorisations are provided to capture the complex structure of argumentation, going beyond a simple dichotomy of economic and cultural frames. Relying on a large and original media dataset covering the period 2004–2006, six Western European countries are investigated.  相似文献

When and why do parliamentary majorities in Europe suppress parliamentary minority rights? This article argues that such reforms are driven by substantive policy conflict in interaction with existing minority rights. Government parties curb minority rights if they fear minority obstruction due to increased policy conflict and a minority-friendly institutional status quo. Empirical support is found for this claim using comparative data on all reforms in 13 Western European parliaments since 1945. A curbing of minority rights is significantly more likely under conditions of heightened policy conflict and these effects are stronger the more the institutional status quo favours opposition parties. Contrary to frequent claims of consensual rule changes from single-country studies in Europe, these findings demonstrate the importance of competitive strategies in explaining institutional reform in European parliaments. The conditional impact of the status quo provides interesting theoretical links to historical institutionalist arguments on path dependence.  相似文献

When Recep Tayyip Erdo?an, as the Prime Minister of the Turkish Republic, declared his government's intention to raise a ‘religious generation’, his proposition drew harsh criticisms from Turkey's secularists, who argued that doing so would clearly challenge the secular nature of the Turkish state. Yet it may come as a surprise to many that it was not a conservative party with Islamist leanings that first experimented with the idea of relying on religious education as an antidote to the perceived moral decadence of the society. Rather, it was the secularist party, the Republican People's Party, which attempted to use religious instruction for the same purpose during the heyday of Kemalism in the 1940s. Against this backdrop, providing an analysis of how the Republican People's Party had come to the point of offering religious education to school children and how it justified this policy can shed light on today's debate on secularism and the secular character of the Turkish state.  相似文献

China has taken advantage of the globalisation process and has become an assembly country for firms in Asia, which have extended their production and trade networks to China. China’s position in the segmentation of the production processes has fostered its trade in high-technology products. However the rapid technological upgrading of China’s trade is associated with an increasing dependence on foreign capital and technology. The emergence of China has led to the reorganisation of production in Asia and to a triangular trade pattern: firms in advanced Asian economies use China as an export base and instead of exporting finished goods to the US and Europe, now export intermediate goods to their affiliates in China.  相似文献
