论公共行政范式的转换与公平效率观的演进

公共行政学自产生以来,经历了传统公共行政范式、新公共行政范式与新公共管理范式相互分立、新公共行政范式与新公共管理范式相互融合三个阶段,呈现出“合——分——合”的态势。而公平效率观也相应地从单纯的效率至上,分裂为新公共行政学派的从公平角度出发寻求公平效率的统一和新公共管理的从效率角度出发寻求公平效率的统一,而最终两种分裂的公平效率观又在新的实践和理论上相互借鉴和整合,走向融合和统一。     

犯罪对象概念的反思与重构

刑法学者之所以在不同场合赋予犯罪对象不同含义,是因为我国刑法理论中的传统犯罪对象概念存在一定的缺陷。有必要重构犯罪对象概念,将“犯罪行为直接作用的具体人和物”与“犯罪客体的直接物质承担者”两种含义适当分离,在理论上区分为直接犯罪对象与间接犯罪对象,二者作为犯罪实行行为指向的事物,有时可发生部分重合,但功能上并不相同,不可相互替代。     

论青少年立法发展阶段及其趋势

Economic voting in South Korea: The 1988 assembly elections

The 1988 Assembly elections in South Korea provide an opportunity to explore whether voting based on short-term economic fluctuations was a feature of the elections. The research design regresses party votes from a large sample of the 224 electoral districts against several well-known determinants of Korean voting behavior (regionalism, urban-rural residence, and social class), as well as district unemployment rates and levels and changes in income. With traditional explanations of voting behavior held constant, income variables had no apparent influence on the vote. However, the coefficients for unemployment rates are large, statistically significant, and in a direction entirely consistent with the theory of rational economic voting. There are grounds for including short-term economic variables in future modeling of Korean electoral behavior.     

论新公共服务与新公共管理

新公共管理和新公共服务是西方新近出现的两种不同的公共行政学范式,后者从不同的方面对前者进行了批判,两者争论的实质为管理主义和宪政主义的不同.然而,在多元行政观的视角下,二者可以作为两种不同的研究途径而得到整合.借鉴多元行政观的思想,中国现阶段的政府管理模式应该是以官僚制为主体,新公共服务和新公共管理为辅助的多元化治理模式.     

服务侵权责任是独立的质量侵权责任

服务侵权责任是一项独立的质量侵权责任。承担服务侵权责任的前提条件是服务存在缺陷,即服务经营者所提供的服务不符合保障人身、财产安全的要求,包括服务设计缺陷、服务指示缺陷和服务过程缺陷。服务侵权责任的归责原则应采取过借推定兼顾公平原则。服务侵权责任与产品责任、建筑侵权责任构成我国“三位一体”的质量侵权责任制度。     

Allele frequencies and haplotypes of the STR loci of the PowerPlex Y-system in southern populations from Korea

In this study, 12 Y-specific STR loci--DYS391, DYS389 I, DYS439, DYS389 II, DYS438, DYS437, DYS19, DYS392, DYS393, DYS390, DYS385a/b--were analyzed in 259 unrelated males from the southern populations in Korea using the PowerPlex Y PCR system.     

Lineup Identification by Children: Effects of Clothing Bias

This study examined effects of clothing cues on children's identification accuracy from lineups. Four- to 14-year-olds (n = 228) saw 12 video clips of individuals, each wearing a distinctly colored shirt. After watching each clip children were presented with a target-present or target-absent photo lineup. Three clothing conditions were included. In 2 conditions all lineup members wore the same colored shirt; in the third, biased condition, the shirt color of only one individual matched that seen in the preceding clip (the target in target-present trials and the replacement in target-absent trials). Correct identifications of the target in target-present trials were most frequent in the biased condition, whereas in target-absent trials the biased condition led to more false identifications of the target replacement. Older children were more accurate than younger children, both in choosing the target from target-present lineups and rejecting target-absent lineups. These findings suggest that a simple clothing cue such as shirt color can have a significant impact on children's lineup identification accuracy.
