Unspeakable Pasts as Limit Events: The Holocaust, Genocide, and the Stolen Generations

This article examines the role of testimony in the production of the memory of the Holocaust and the practice of forcible removals in Australia as "limit events". A "limit event" is an event or practice of such magnitude and profound violence that its effects rupture the otherwise normative foundations of legitimacy and so-called civilising tendencies that underlie the constitution of political and moral community. The references are the stories of removal collated in Bringing Them Home , and eyewitness testimonies from the trial of Adolf Eichmann in Jerusalem in 1961. By situating the stolen generations and the Eichmann trial as limit events, I argue that the effects of witnessing and story-telling exposed a cultural semantics of what was speakable and unspeakable in the narratives of judging historical injustice and remembering past traumas.     

Genocide yet again: Scenes of Rwanda and Ethical Witness in the Human Rights Memoir

This article investigates three recent human rights memoirs that chronicle the Rwandan genocide of 1994: Emergency Sex (and other desperate measures): True Stories from a War Zone, Shake Hands with the Devil: the failure of humanity in Rwanda, and The Zanzibar Chest: a memoir of love and war. I use these memoirs to explore the complexities of bearing witness to ethnic violence and war as an autobiographical subject shaped by the memory of historical atrocity — as a besieged self in traumatic occupations of the UN protector (Roméo Dallaire), lawyer (Kenneth Cain), and war correspondent (Aidan Hartley). Finally, I suggest that the authors of these memoirs are secondary witnesses, claimants to ethical truths and writers of atrocity testimony that complicate the burgeoning life‐telling compulsion of what is and who can claim to be a genocide victim. “Your mind with time, in fact, doesn't erase things that are traumas. Remembering Civil Patrols in Joyabaj, Guatemala

During the civil war in Guatemala, which only ended with the signing of the comprehensive Peace Accords in December 1996, the military organised the male population throughout the Guatemalan highlands into civil defence patrols (Patrullas de Autodefensa Civil, PAC). Initially set up to help the military to win the war, they eventually evolved into a local power player in their own right. Although the patrols were dismantled in 1996, former patrols still influence daily life. This paper examines how, at the municipal level, current memories of the civil war, especially of the civil defence patrols, still shape perceptions, actions, and social relations. These are marked by fear, prejudice, and distrust, thereby creating important impediments for erasing the legacy of violence and building local democracy and civil society.     

Medicaid Section 1115 Waivers: Shifting Health Care Reform to the States

This article focuses on recent developments in state Medicaidprograms and the role ojSection 1115 waivers in this process.The evidence presented here demonstrates quite clearly thatthe states are using Section 1115 waivers to experiment witha broad range of innovative health-care service delivery, reimbursement,and eligibility concepts. This has allowed the states to reconfiguretheir Medicaid systems. More important, perhaps, the use ofSection 1115 waivers has also increased the role ofof the statesin the American health-care policy process.     

Minor or adult? Introducing decision analysis in forensic age estimation

Nowadays, forensic age estimation takes an important role in worldwide forensic and medico-legal institutes that are solicited by judicial or administrative authorities for providing an expert report on the age of individuals. The authorities’ ultimate issue of interest is often the probability that the person is younger or older than a given age threshold, which is usually the age of majority. Such information is fundamental for deciding whether a person being judged falls under the legal category of an adult. This is a decision that may have important consequences for the individual, depending on the legal framework in which the decision is made. The aim of this paper is to introduce a normative approach for assisting the authority in the decision-making process given knowledge from available findings reported by means of probabilities. The normative approach proposed here has been acknowledged in the forensic framework, and represents a promising structure for reasoning that can support the decision-making process in forensic age estimation. The paper introduces the fundamental elements of decision theory applied to the specific case of age estimation, and provides some examples to illustrate its practical application.     

Hybrid Warfare,International Negotiation,and an Experiment in “Remote Convening”

The authors are leading a multinational effort to understand the effects of “hybrid” warfare on international commercial negotiation. The start-up process is itself essentially a negotiation, among about forty individual practitioners and scholars with very diverse backgrounds, over whether and how they will work together. In a pandemic, a key risk is that the necessary cooperation and trust will be harder to build, particularly among professionals who are dealing with security-sensitive issues and who have never met each other. This article discusses the current necessity of replacing the in-person model for eliciting such cooperation which the authors had developed previously for large collaborative projects, and describes a “remote convening” replacement process.     

To adapt or to defend? Comparing position shifts among Bundestag candidates between 2013 and 2017

In this research note, candidate survey data from the German Longitudinal Election Study (GLES) is used to analyse positional shifts of German Bundestag parties between 2013 and 2017. Two developments make Germany a particularly interesting case: (1) the liberal but also controversial policies of the Merkel cabinet during the European refugee crisis and (2) the change of leadership within the right-wing populist party Alternative für Deutschland (AfD). Applying scaling techniques to locate candidates of both elections in the same two-dimensional policy space, the analysis demonstrates that in 2017 the AfD took a distinct radical right position in the party system of Germany. Moreover, the study finds that almost all parties moved to the right on the cultural left–right dimension in 2017, whereas for the economic left–right dimension this has not been the case. Contrary to the mantra of an ideological delineation against right-wing populism, there has been a robust socio-political conservative shift in the German party system.     

An analysis of the relationship between the additionality of CDM projects and their contribution to sustainable development

The Clean Development Mechanism (CDM) allows industrialised countries to use credits from greenhouse gas abatement projects in developing countries in order to fulfil their own emission reduction commitments. There has been mounting evidence that the CDM’s ability to fulfil its goals as stipulated by the Kyoto Protocol—contributing to the sustainable development of the host countries and delivering real, measurable and additional emission reductions—is less than satisfactory. In this article, an evaluation is made of CDM projects’ likelihood of being additional by assessing the impact Certified Emission Reductions have on the Internal Rate of Return of the individual projects. In addition, the projects’ sustainable development benefits are assessed by using a multi-criteria analysis. In a final step, the relationship between the projects’ additionality and sustainability contribution is assessed and a trade-off between these two CDM goals is established, revealing a potential inherent conflict in how the current mechanism works. The analysis is based on a systematic evaluation of 40 registered CDM projects in India.
