The Special Court for Sierra Leone, a hybrid criminal tribunalestablished to try persons accused of serious crimes duringthe conflict in Sierra Leone, has recently commenced its judicialoperations. Several of the preliminary issues raised by variousdefendants have required the Court to examine the validity ofthe amnesty granted to combatants by the Lomé Peace Agreementand the amnesty's impact upon the Court's jurisdiction to trythe defendants. This article examines the decisions of the Courton the amnesty issue and evaluates the jurisprudence of theCourt with reference to the current status of amnesties in internationallaw.  相似文献

Using data from the new National Incident-Based Reporting System (NIBRS), this study analyzed the impact of a criminal offender's sex on the likelihood of arrest for 555,752 incidents of kidnapping, forcible rape, forcible fondling, robbery, aggravated assault, simple assault, and intimidation in nineteen states and the District of Columbia during 2000. The data used in this study advanced the literature by enabling the authors to determine the likelihood of arrest for males and females based on sex-specific offending as reported by crime victims. Controlling for offense seriousness and a variety of other factors, logistic regression results showed that the probability of arrest for females was 28 percent lower for kidnapping, 48 percent lower for forcible fondling, 9 percent lower for simple assault, and 27 percent lower for intimidation than for males. A supplemental analysis also revealed that Black females had a higher probability of arrest than did White females for aggravated and simple assault. No discernable impact of an offender's sex on the prospect of arrest was noted for the crimes of forcible rape and robbery. Overall, these findings suggest that the lower arrest rate for females is partly the result of leniency shown women by law enforcement personnel.  相似文献

Ten years after the 1994 Rwandan genocide occurred, seriousquestions remain about the circumstances of the British government'sresponse. This article critically evaluates the response ofJohn Major's government to the genocide. It does so in fourstages. The first section provides a brief overview of the Majorgovernment's international agenda in 1994, focusing on Britishpolicy towards the war in Bosnia and the African continent ingeneral. The second section deals with the substance of Britain'sRwanda policy, while the third discusses the ways in which thispolicy has been almost totally omitted from mainstream accountsof this period. The final section provides a critical evaluationof some of the tactics that British officials employed to avertcriticism of their government's policies. Based on the evidencepresented we conclude that the British government displayeda deeply troubling indifference towards the victims of Rwanda'sgenocide.  相似文献

Although many police departments use Special Weapons and Tactics (SWAT) teams, surprisingly there is very little research on them. This study examined the use of force by SWAT and non-SWAT police officers. SWAT officers may be socialized to use force as a result of the dangerous situations they frequently encounter, and thus more likely to use force in non-SWAT situations. The results of this research note, however, indicated there was a statistical nonsignificant relationship between SWAT status and the use of force. Implications of the findings of this study are discussed.  相似文献

Abstract: The EU's human rights policy has provoked increasing scholarly attention over the last decade. Yet rarely has it been subjected to rigorous analysis in the context of any integration theory. This article is an attempt to rectify the omission. By building on the approach of historical institutionalism, whilst at the same time recognising its analytical deficiencies, a method of reading the EU and interpreting its human rights policies is promoted. Specifically, the article contends that an analysis based on the textual nature of the EU and the configuration of this text through ‘institutional narrative’ will enable a better understanding of the institutional logic behind the construction of human rights policy. An agenda for research and analysis is thus suggested that might map the development of human rights in the EU and predict the compass of future policy direction more effectively.  相似文献

This article discusses the early history of performance and productivity measurement. It finds sophisticated development of these tools beginning in the first decade of the twentieth century, primarily at the New York Bureau of Municipal Research. These practices grew out of accounting, the social survey, work records, and municipal statistics. The bureau built government's capacity to measure. They advocated such basic empirical practices as making observations at all, doing so systematically and routinely, and recording data at the time of observation. By 1912, performance measurement exhibited many of the features associated with the modern practice: measuring of input, output, and results; attempting to make government more productive; making reports comparable among communities; and focusing on allocation and accountability. Performance measurement was developed in the context of shifting power between the elected executive and the legislature.  相似文献
