In the 1970s Washington State lost a series of legal cases related to Native Americans. These cases exemplify the need for knowledge of federal Indian law-but such knowledge, out of context, is insufficient. Key aspects of federal Indian law are hard to accept because of conflicting stories that Americans already believe. The authors discuss the importance of stories and review commonly believed stories that block acceptance of federal Indian law. They then discuss basic principles of Indian law and distill four questions to help determine tribal jurisdiction. The authors review the Marshal trilogy—three Supreme Court cases that set the foundations of modern Native American law—and show how the legal principles play out in an analysis of three contemporary court cases. 相似文献

Empirical studies measuring the impact of globalization on social spending have appeared recently in leading journals. This study seeks to improve upon previous work by (1) employing a more sophisticated and comprehensive measure of financial openness; (2) using a more accurate measure of trade openness based on purchasing power parities; and (3) relying on social spending data that are more complete than those used by previous studies on Latin America. Our estimates suggest that several empirical patterns reported in previous work deserve a second look. We find that trade openness has a positive association with education and social security expenditures, that financial openness does not constrain government outlays for social programs, and that democracy has a strong positive association with social spending, particularly on items that bolster human capital formation. 相似文献

Over the past 20 years, the number of patents assigned to universities has increased dramatically. This increase coincided with several policy initiatives, such as the Bayh‐Dole Act of 1980, designed to foster technology transfer between universities and the private sector. This paper examines the effect of such policies using an institutional framework, designed to illustrate how factors both from inside and outside of academia influence the decision to patent university research. We find passage of the Bayh‐Dole Act spurred university patenting, but did not induce additional applied research funding. Recently, we proposed an original statistical model for forecasting general elections in the United Kingdom, based on the observation of a few key indicators of the political and economic system. That vote function model was tested against the results of the 2001 general election. Here we evaluate the results of that test, and offer an appropriately revised model for the forecasting of the upcoming 2005 general election. Community, demographic, familial, and personal risk factors of childhood depressive symptoms were examined from an ecological
theoretical approach using hierarchical linear modeling. Individual-level data were collected from an ethnically diverse (73%
African-American) community sample of 197 children and their parents; community-level data were obtained from the U.S. Census
regarding rates of community poverty and unemployment in participants’ neighborhoods. Results indicated that high rates of
community poverty and unemployment, children’s depressive attributional style, and low levels of self-perceived competence
predict children’s depressive symptoms, even after accounting for demographic and familial risk factors, such as parental
education and negative parenting behaviors. The effect of negative parenting behaviors on depressive symptoms was partially
mediated by personal variables like children’s self-perceived competence. Recommendations for future research, intervention
and prevention programs are discussed.

This study investigated the relationship between social information processing (SIP) and both relational and overt, physical
aggression in a longitudinally-followed sample of 228 adolescent girls (ages 11–18; 140 with ADHD and 88 comparison girls).
During childhood, girls participated in naturalistic summer camps where peer rejection, overt physical aggression, and relational
aggression were assessed via multiple informants and methods. Approximately 4.5 years later, these girls participated in follow-up
assessments during which they completed a commonly-used vignette procedure to assess SIP; overt and relational aggression
were again assessed through multiple informants. Correlations between (a) overt and relational aggression and (b) maladaptive
SIP were modest in this female adolescent sample. However, relationships between aggression and SIP were stronger for the
comparison girls than for the girls with ADHD. The relevance of SIP models for adolescent girls and clinical implications
of findings are discussed.

Suicide is an important public health problem in China: It is the fifth leading cause of death in China, and suicide in China accounts for over 30% of the world's overall suicide deaths. The substantial burden due to suicide has not been well recognized. This study aims to provide an estimate of the socioeconomic burden of the suicide problem in China in terms of years of life lost (YLL) and to discuss its implications. Suicide rates and the related YLL by age, gender, and region (urban/rural) from 1990 to 2000 were estimated using the most recent data from the Ministry of Health of China. The suicide rate in rural China was three times higher than that in urban areas. Suicide completers in rural areas shared 90% of total YLL. Rural women aged 25-39 years contributed the largest share of YLL. Our results show that some population subgroups contributed a disproportionate share to the disease burden of suicide. National strategies for suicide prevention should include targeted programs in catering the need of these specified subgroups in China. 相似文献

The notice and comment rulemaking process is a fundamental part of how agencies write regulations. While this process is starting
to receive more empirical attention, the question of how the number of comments that an agency receives affects its decision-making
process has received little examination. This paper uses Boolean analysis to examine nine rules from two agencies at the Department
of Health and Human Services and evaluates the impact of a high volume of comments on agency changes to proposed rules and
the time an agency takes to finalize a proposed rule. These nine cases suggest that agencies are most likely to change their
proposals when they receive a high volume of comments on highly complex rules that are not very politically salient. Highly
complex rules are also likely to take a long time to finalize when there are many public comments however it is often other
factors that cause a long delay between proposed and final rules.
