在足迹鉴定中,对于一些因某种因素影响而形成的不正常的步幅特征的鉴定,除了运用一般的方法进行检验外,还应该运用一些定量检验的方法进行鉴定。通过对具体案例中级差检验法的实验,分析研究了由于心理因素和步行速度的影响使步幅特征中各量值的变化情况,为此类案件提供了重要的检验依据。     

A tide that does not lift all boats: the surge of remittances in post-disaster recovery in Tacloban City,Philippines

For the last forty years, remittances have been a lifeline for some Filipinos in times of crisis as well as everyday life. So, it was no surprise when the media and nongovernmental organizations credited the Philippine diaspora with playing a significant role in post-disaster recovery after Typhoon Haiyan/Yolanda struck in 2013. While remittances poured in after this disaster, they were differently experienced, had different impacts, and led to uneven post-disaster outcomes. This article highlights the class-based inequalities that structure access to and mobilization of remittances after post-disaster recovery. We compare the experiences of middle- and lower-class households in three communities heavily affected by Haiyan in Tacloban City, Philippines, to investigate who benefitted and who was excluded from remittances in this post-disaster recovery. The findings of the case study shed light on wider issues of poverty, class, and vulnerability in the Philippines.

浙江经济已步入依靠技术进步和产业结构升级推进现代化阶段,人力资本扩展是推进这一进程的推动器.浙江原有的人力资本存量和独特禀赋在市场取向改革先发条件下发挥了令人称羡的作用,然而,人力资本增量增长缓慢、存量结构错位、支撑不足也正引起浙江经济产学界的高度关注.重视人力资本投资,通过实施多元、多形式人力资本扩展措施,实现产业结构升级与经济社会持续发展,是新阶段浙江发展战略的必然选择.     

EU public diplomacy in Asia: a case study of the EU Center in Taiwan

Since 2004, the EU has created 11 EU centers and two center-modeled programs in East Asia as an integral part of its public diplomacy in order to “promote the study, understanding, and support of the EU and its policies.” All of these centers were jointly established by the EU and local universities, and more than 50 % of their funding is offered by the EU institutions. Among these centers and programs, the EU Center in Taiwan (EUTW) distinguishes itself from the others in two ways. On one hand, similar to the EU Center in Singapore, it acts as a national center rather than a university center. On the other hand, it was jointly inaugurated by a consortium of seven universities rather than one or two universities across the island. Therefore, this paper aims to evaluate the EU public diplomacy in Asia with the help of soft power theory and an in-depth case study of the EUTW. I will firstly review the development of the EU Studies and EU-related communities in Taiwan before the EUTW was formally inaugurated in May 2009. In the second part, I will present an in-depth analysis of the structure and functioning of the EUTW in terms of EU public diplomacy on the island. In the third part, the work of EUTW in the promotion of study, understanding, and even support of the EU and its policies will be evaluated with help of an institutionalist framework. In the end, I will give a balance sheet of the EUTW in terms of EU public diplomacy before drawing into some conclusions.     

司法鉴定启动条件研究

我国诉讼法对司法鉴定及鉴定意见的制度性缺位使得鉴定意见从“证据之王”沦为“是非之王”.司法鉴定的启动制度是连接司法鉴定管理制度与鉴定意见证据制度的桥梁,立法完善与实践问题的解决应当重视对司法鉴定启动规则的建构.诉讼法应当明确规定司法鉴定的启动条件,鉴定事项与案件事实之形式关联性、鉴定必要性是启动司法鉴定的一般性条件.此外,应当规定可能被判处死刑的案件、被告精神状态存疑的案件以及特定情形下法院依职权的司法鉴定强制启动制度.同时,应当结合现有相关立法来设定补充鉴定及重新鉴定的启动条件.     

青少年感恩品质形成机制研究

青少年感恩品质的培养,既要通过合理的方式使他们形成感恩意识和正确的应得观,并注重培养他们人际感(即辨认和识别他人感受的能力)和意志品质,也要注意引导关怀者或施惠者(主要是成人)形成正确的关怀意图和动机,同时社会也不仅要有正义更要充满人性关怀,这些是青少年体验幸福和产生感恩的基础.     

和谐文化建设与大连建设创新型城市问题研究

在2006年1月召开的全国科技大会上。中共中央总书记胡锦涛提出了建设"创新型国家"的重大战略任务,在这样的大背景下,我们大连市正在努力建设创新型城市,但是在建设创新型城市中一个不容忽视的关键环节是和谐文化的建设,可以说和谐文化建设和大连的创新型城市建设是相辅相成的。要在认清和谐文化建设与大连建设创新型城市关系的前提下,推动大连和谐文化建设,以达到促进大连创新型城市建设的目的。     

拉美左派崛起与左派政府的变革

进入21世纪以来的短短几年间,一批"左派政府"的崛起导致了拉美政治版图的大改组,并标志着一股新的变革潮流的出现。当前被国际舆论公认为左派当政的拉美国家有委内瑞拉、智利、巴西、阿根廷、乌拉圭、玻利维亚、厄瓜多尔和尼加拉瓜等8国。拉美国家的左派政府都是通过选举取得执政地位的,即所谓"体制内的崛起"。迄今为止,这些政府所实行的变革也都没有超出"体制内变革"的范畴。本世纪初期这种左派政府在拉美"集体亮相"的局面,的确有给人耳目一新之感。这种新局面的出现与最近30年来拉美地区"政治民主化"变革、新自由主义经济改革等引起的深刻社会变动是分不开的。广大民众反对新自由主义、要求改变现状的呼声高涨和社会运动的广泛兴起,是左派政府崛起最基本的政治与社会基础。     

著作人格权制度的反思与重构

作品和作者人格之间的关系是全部著作人格权理论的逻辑起点,在此基础上形成的著作人格权制度缺少强有力的支撑理论,存在着严重的理论缺陷。在实践中,著作人格权制度既与民法人格权制度之间存在着难以调和的冲突,破坏了人格权制度的统一性,也不利于保障作者的私益和社会文化发展利益。这就需要将署名权、完整权、发表权等权利从民法人格权制度框架中解放出来,从经验出发,通过考察这些权利的实际功能,将其界定为专属于作者的各种辅助性权能,重新建构作者专属辅助权制度体系。
