Gem § 43 Abs 4 StPO ist ein Richter von der Entscheidung über einen Antrag auf Wiederaufnahme ausgeschlossen, wenn er im Verfahren bereits als Richter t?tig gewesen ist. Das gilt auch für Rechtsmittelrichter uneingeschr?nkt. Jede im (Grund-)Verfahren erfolgte Befassung eines Richters mit der Sache selbst führt dazu, dass er in Ansehung einer Entscheidung über einen Antrag auf Wiederaufnahme des Verfahrens ausgeschlossen ist. This article sets out to critically explore an important dimension of the International Monetary Fund's (IMF) recent bid for economic stability, namely the transparency requirements vis-à-vis emerging market economies. The article argues that this requirement symbolises an attempt to bolster ideological obligation to neoliberalism while progressing towards a certain form of legal obligation between states. This claim is developed by first identifying three facets that have undermined the economic stability of the global system: (1) the emergence of 'competition states'; (2) a non-hegemonic political economy; and (3) the reperipheralisation (or re-marginalisation) processes in the global South. After establishing this larger analytical backdrop, the article goes on to evaluate the Fund's transparency requirements as an attempt to preserve the status quo in the global political economy.  相似文献

For over a century, the Canadian state funded a church-run system of residential schools designed to assimilate Aboriginal children into Euro-Canadian culture. In addition to the problems associated with its ethnocentric philosophy, the school system was also characterised by terrible health conditions and physical and sexual abuse of the students was widespread. Recently, the schools have been the object of the most successful struggle for redress in Canadian history. One particularly puzzling aspect about the school system is that it persisted for so long, despite that many of its failings were known very early in its operation. In this article, this puzzle is addressed via a cultural analysis of a political struggle over the residential schools that occurred within Canadian Anglicanism at the outset of the twentieth century. The article concludes that the meaning of the school system as a sacred enterprise contributed to its persistence.  相似文献

The 2011 Libyan civil war prompted a reassessment of the normative foundation of the EU's conventional arms export control regime as armaments manufactured in Europe were used by Gaddafi's forces during the war. The EU's foreign policy identity is based, partly, upon a common approach to arms export involving respect for common criteria for export licences. Yet, prior to the civil war, considerable amounts of military equipment had been exported by member states to Libya, notwithstanding grounds for restraint on the basis of several of the criteria. This article traces member states' arms export to Libya during 2005–2010 to explore whether member states favoured restraint or export promotion. It concludes that although aware of the risks of exporting, in a competitive market for military goods, member states sought commercial advantage over restraint, and comprehensively violated export control principles. This casts doubts on assertions of the EU acting as a “normative power”.  相似文献

This article investigates how the economic role of the state shapes the relationship between economic development and democracy. We argue that the state is not passively under the influence of socio-economic development as assumed in extant empirical studies. Through participating in economic production, the state is able to mitigate positive effect of economic development on politics through shaping the strength and preference of both the state and the societal forces in a way unfavourable for democracy. We thus model the state's economic engagement as a moderator variable to capture the variation in the effect of economic development on regime transition. Empirical analyses consistently show that state engagement attenuates the positive effect of development on probability of democratic transition. And economic development benefits democracy only when the level of state engagement in the economy is relatively low.  相似文献

Abstract

The present study examined the behavioural differences in sexual assault offences in relation to the offender–victim relationship (stranger versus non-stranger). These differences were examined specifically in the context of four interpersonal themes of interaction: dominance, submission, hostility and cooperation. The details of 100 sexual offence cases (50 stranger and 50 non-stranger) were content-analysed, generating 58 dichotomous variables, covering offender and victim behaviour during the offence. χ2 tests comparing the two samples found that offenders who were strangers to their victims were more likely than non-stranger offenders to display behaviours that indicate a hostile, violent offence style. In contrast, those offenders who knew their victims were more likely than strangers to display a less violent and more personal, compliance-gaining offence style. These findings are discussed in terms of their implications for offender rehabilitation and victim support.  相似文献
