Governance theory shows that governments no longer operate as actors that take unilateral decisions but instead have to share power and influence with various other actors. There is also a large body of literature that shows a growing discontent with (local) democracy. These two trends lead various local governments to either reaffirm representative democracy, or to introduce elements of direct participatory democracy. In practice the combination of the two – representative and direct participatory democracy – can be problematic. This paper describes the experiences of Hoogeveen, a medium-sized municipality in the Netherlands with a far-reaching programme of direct participatory democracy. In Hoogeveen, local residents can decide on yearly budgets for their neighbourhood and become involved in the long-term planning of its development. The Hoogeveen case shows that direct participatory and representative democracy can be balanced with the help of (1) connecting arrangements, (2) professional connectors and (3) steady political support. 相似文献

Proper interpretation of forensic measurements can be critical to the administration of justice. Breath alcohol testing is commonly relied upon to measure the concentration of alcohol in breath or, indirectly, in blood. The concentration sought constitutes the “quantity intended to be measured,” referred to as the measurand. Although breath tests always probe the same physical quantity, their measurand is dictated by statute and varies between jurisdictions. Thus, identical numerical values obtained from tests in disparate jurisdictions may refer to different quantities and may not indicate the relevant statutory measurand. This can lead to misinterpretation of results, referred to as the “measurand problem.” We first illustrate the concept of the measurand. Thereafter, the measurand problem is illustrated through application of Hlastala's breath test paradigm and Gullberg's work on breath test uncertainty. It is shown that where the measurand is not properly accounted for, conclusions based upon breath test evidence are undermined. 相似文献

The State of Texas began enforcement of the Woman's Right to Know (WRTK) Act on January 1, 2004. The law requires that all abortions at or after 16 weeks' gestation be performed in an ambulatory surgical center (ASC). In the month the law went into effect, not one of Texas's 54 nonhospital abortion providers met the requirements of a surgical center. The effect was immediate and dramatic. The number of abortions performed in Texas at or after 16 weeks' gestation dropped 88 percent, from 3,642 in 2003 to 446 in 2004, while the number of residents who left the state for a late abortion almost quadrupled. By 2006, abortions at or after 16 weeks' gestation in a nonhospital setting were available in four major cities in Texas (down from nine in 2003), and the abortion rate at or after 16 weeks' gestation remained 50 percent below its pre‐Act level. Understood primarily as a meta-narrative reflecting citizens' reluctance to accept migration and Islam as permanent components of their society, grass-roots protests against mosque construction also highlight a democratic paradox regarding multi-level governance: while national governments bear chief responsibility for ensuring fundamental religious freedoms, local authorization procedures affecting mosque construction (e.g. zoning, building permits) have rendered communal spaces a Ground Zero for the regulation of Islamic faith communities. While similar protests have taken place across Europe, German officials face special problems in responding to challenges by neighbourhood groups, rooted in the complicated nature of federalism, the legacy of National Socialism and a new, if misunderstood, element of ‘militant democracy’ at local levels. The Pankow-Heinersdorf case, staged on the outskirts of eastern Berlin, shows that multifaceted interventions can help contesting parties come to terms with religious differences, develop their networking and dialogue skills and actually contribute to more effective democratic participation at the local level. 相似文献
