In ten member states of the European Union (EU) the new constitutional treaty was supposed to be ratified by referendum. A growing number of theoretical models predicts that such additional ratification hurdles result in an advantage for negotiators in the bargaining game. The impact such a referendum constraint can exert, however, depends on the timing of its announcement, the remaining ratification rules as well as the preference constellations. If parliament and voters are actually in favor of the new treaty, ratification constraints may cease to affect the bargaining outcome. After presenting the theoretical foundation of these arguments, we present empirical evidence much in line with the theoretical implications. More specifically, especially for the issues changed during the intergovernmental conference, those governments gained that had scheduled a referendum and voters had a stronger preference for the status quo.

Purpose. Numerous wrongful convictions have brought into question the ability of judges and juries to accurately evaluate the credibility of witnesses, including defendants. Dangerous decisions theory (DDT) offers a theoretical framework to build our understanding of the decision‐making process that can culminate in such injustices. Arguments. According to DDT, the reading of a defendant's face and emotional expressions play a major role in initiating a series of ‘dangerous’ decisions concerning his/her credibility. Specifically, potent judgments of trustworthiness occur rapidly upon seeing a defendant's face, subjectively experienced as intuition. Originally evolved to reduce the danger to the observer, the initial judgment – which may be unreliable – will be enduring and have a powerful influence on the interpretation and assimilation of incoming evidence concerning the defendant. Ensuing inferences will be irrational, but rationalized by the decision maker through his/her subjective schemas about trustworthiness and heuristics for identifying deceptive behaviour. Facilitated by a high level of motivation, a non‐critical, tunnel vision assimilation of potentially disconfirming or ambiguous target information can culminate in a mistaken evaluation of guilt or innocence. Conclusions. Empirically based education and responsible expert testimony could serve to reduce such biases and improve legal decision‐making.  相似文献

We have implemented and validated automated methods for DNA extraction and PCR setup developed for a Tecan Freedom EVO® liquid handler mounted with a Te-MagS™ magnetic separation device. The DNA was extracted using the Qiagen MagAttract® DNA Mini M48 kit. The DNA was amplified using AmpF?STR® Identifiler®, Y-filer® (Applied Biosystems), GenePrint® FFFL and PowerPlex® Y (Promega). The methods were validated for fresh whole blood and blood from deceased according to EN/ISO 17025.  相似文献

Since the early 2000s, both US and EU Preferential Trade Agreements (PTAs) include social standards that aim to protect workers and the environment. However, the US and the EU have chosen fundamental different approaches for the enforcement of these clauses. While the US pursues a sanction-based approach, the EU solely relies on dialogue and cooperation mechanisms. Hence, to the surprise of many, social standards in U.S PTAs appear to be stricter than the ones in EU PTAs. Why do the two biggest trade powers of the world handle social clauses in PTAs so differently? In this paper, I argue that disparities in domestic politics account for their different strategies towards social standards. Drawing on the principal-agent literature, the paper analyses the PTA negotiations of the US and the EU with Peru and Colombia.  相似文献

Recent scholarship on advisory systems has focussed on the externalization of advisory capacities and sectoral dynamics of change, whereas changes of internal policy advisory systems have not yet been approached systematically. This article proposes an analytical concept for exploring change dynamics in internal policy advisory systems by means of three logics for assessing policy advice (political salience, credibility and representativeness). The approach is illustrated by analysing changes within the internal policy advisory system of the German federal government (1990–2015). The analysis relies on three original datasets on ministerial departments, research agencies and governmental advisory bodies. We find that the internal advisory system of the German federal government is characterized by a differentiated hybridization of advisory logics, which has changed the nature of policy advice.  相似文献
