Constitutional Rights in the Irish Home Rule Bill of 1893

In 1893, Prime Minister Gladstone introduced the second Irish home rule bill in parliament. The bill broke with tradition in Britain and the empire, as it included provisions from the bill of rights of the United States. Its significance was clear at the time: it was debated for nine days in the committee stage and, with one minor amendment, it remained part of the bill that passed the Commons. However, the bill was defeated in the Lords and, at least in the United Kingdom, bills of rights were dismissed as unnecessary or detrimental to sound governance until well after the second world war. This article therefore tries to understand how this early bill of rights was regarded at the time. Who suggested, or demanded, its inclusion? How did they expect it to be applied? And how did the debate reflect and influence thinking about constitutional law in Britain and the empire?

There is worldwide interest and concern over the pending US Presidency of Donald Trump. This article recounts the experience of the author and entrepreneur Merv Griffin with Trump in his business career and suggests clues for examining his exercise of the power of the Presidency. His choices for his cabinet and his advisers may well determine his success or failure. The evidence thus far is troubling.     

从项目嵌入到组织社会:村级集体经济发展的新趋势及其类型学研究

发展和壮大村级集体经济是乡村振兴战略的重要内容。既有研究在探讨村级集体经济问题时较多地聚焦于其功能和目的、历史与现实、发展原则和要求,而较少关注到村级集体经济的发展趋势及其在不同村庄所呈现出的异质性特征。基于"项目嵌入-公众参与"的二维分析框架和浙北J市S镇的田野调查发现:新时期村级集体经济发展出现了由依赖纵向国家项目嵌入向组织和激活横向社会网络转变的新趋势,其发展形式呈现出政社耦合型、社会嵌入型、政治嵌入型和双重脱嵌型四种理论类型。村级集体经济发展类型上的差异也导致了其在村庄治理实践中发挥的分配、互惠、悬浮、兜底保障等不同功能,以及国家治理机制上的分殊。此外,村级集体经济的发展在不同类型的村庄面临着不尽相同的内外限制性条件。     

社会主义新农村建设中的政府能力——公共产品的视角

社会主义新农村建设是我国现代化的一个关键环节.从一定意义上说,社会主义新农村的建设过程就是农村公共产品供给效率的改善及供给结构的优化过程.从公共产品的视角出发,有利于深入探讨社会主义新农村建设中政府能力的本质、问题与成因,政府与乡村自组织的关系等重要方面.我们认为,政府是农村公共产品的主要责任者,政府供给农村公共产品的程度与质量是政府能力的重要表现;农民的自组织化是提高农村公共产品供给效率及促进基层民主发展的内在要求;厘清政府与乡村自组织的关系是社会主义新农村建设的应有之义.推进社会主义新农村建设,要求政府既能够承担农村公共产品的供给责任,又能够在公共产品供给中处理好与乡村自组织的关系,为此,应当划分好政府在农村公共产品供给中的责任;改革乡村治理结构,提升基层政府的能力;培育农村自治组织,提高农村公共产品的供给效率;处理好政府与农村自组织的关系,促进农村基层民主的发展.

网络开辟了青年社会化的崭新时代,为青年提供了新的广阔空间,但在其消解传统的社会化模式,带来众多积极效应的同时,也应认识到网络社会化自身的局限与副作用.对这一问题的重视和探讨,将有助于进一步促进青年社会化的健康发展.     

The politics of HIV/AIDS in South Africa: government action and public response

A decade ago it seemed likely that African governments would be destabilised by the impact of the HIV/AIDS epidemic. This article tests some of the presumptions in such forecasting with an examination of the South African case. It begins with an assessment of the effects on the public health system of the South African government’s efforts to cope with the illness. Efforts to implement universal treatment of people who are HIV-positive appear to have strengthened government, while the costs have been affordable. The efforts have extended the embrace of the public health system and prompted the engagement of civil society in policy formation and implementation. Survey evidence suggests that the government has gained public approval and that its health service delivery has become more socially accountable. Civil protest to engender political reforms in the treatment of AIDS patients has enhanced the role of constitutional checks on executive authority.
