This article demonstrates that in recent years, patent settlements between branded and generic manufacturers involving "reverse payments" from branded manufacturers to generic manufacturers have received close antitrust scrutiny, driven by concerns that such settlements harm consumers by delaying the entry of lower-priced generic drugs. The authors note that such settlements will be a focus of the Obama Administration's antitrust enforcement policy, yet there is a growing consensus among the courts that such settlements are anticompetitive only under narrow sets of circumstances. In this article, the authors present an analytical framework for evaluating the competitive effects of patent settlements, including those involving reverse payments, and demonstrate that these settlements can benefit consumers. Thus, the authors conclude that while continued scrutiny of such settlements is important, broad brush treatments are inappropriate and only a more individualized evaluation can correctly determine the competitive effects of a particular settlement agreement. 相似文献

The present investigation examined the risk, need, and responsivity (RNR) correlates of MMPI-2 scores in a Canadian sample of 349 federally incarcerated sex offenders, followed up prospectively 19 years post-release. In terms of responsivity indicators, more serious profile patterns were associated with younger age, single marital status, lower education, and lower cognitive ability; the scales generally had weak associations with sex offender treatment completion or change. With respect to criminogenic risk and need, Scales F, 4, 6, 8, and 9 and combinations therein had significant associations with structured measures of sex offender risk, and in turn, consistently predicted sexual or violent recidivism over 5 and 10-year follow-ups. Several of these predictive associations were maintained even after controlling for static and dynamic risk factors. Finally, model based clustering of the MMPI-2 scales generated three clusters termed disordered, emotionally distressed, and predominantly antisocial (non-disordered) subtypes. Although comparatively higher rates of violent recidivism were found with the disordered subtype, this group did not have higher levels of risk and need, broadly speaking, than the other subtypes. Over the past few decades researchers have begun to examine the importance of understanding positive youth development and the many contexts in which youth find themselves. The social contexts in which adolescent development occurs are varied and complex, particularly the development among African American youth. African American youth are faced with a number of challenges including living in single-parent homes, high teen pregnancy rates, and poor neighborhoods, yet many of these youth continue to thrive. The purpose of this study was to examine the relationship between family structure (single-parenting) and adolescent outcomes such as educational aspirations and sexual activity among African American adolescent youth aged 12–17. Approximately 462 African American youth were surveyed. A number of positive results emerged; for instance, there was a negative correlation between family structure and educational aspirations. The number of parents in the home did not interfere with youth wanting to complete high school and go on to college (r = ? .218, r² = .04, p < .05). The results also showed that as educational aspirations increased, the number of sexual partners decreased (r = ? .141, meaning that the more adolescents reported a desire to complete high school, they were less likely to report having sexual intercourse. These positive results should be promoted among African American youth so that those faced with these challenges will note that others have overcome and accomplished their goals. The purpose of this article was to assess the overall health behaviors of African American emerging adults who live in a Midwestern city. Two hundred participants, ages 18–25, completed a 129-item survey. Results indicate that African American emerging adults are engaged in relatively healthy behaviors (i.e., physical activity, low substance use). The results also showed that within the emerging adult developmental period, there are differences in behavior for those who are in the younger (18–20) versus those that are older (21–25) in the developmental period. In its first 2 decades the Canadian Institute of International Affairs (CIIA), Canada's premier foreign policy think tank, never functioned merely as a neutral and apolitical research organization. Under the leadership of Edgar Tarr, president of the Monarch Life Assurance Company, and in its capacity as the Canadian Council of the transnational Institute of Pacific Relations (IPR), in the 1930s and 1940s the CIIA became an instrument that championed Canadian national autonomy and sought to expand Canada's international role, while challenging British imperialism, racism, and Anglo–Saxon dominance. Prominent Canadian diplomats and other officials were complicit in this enterprise, which reached its apogee at the IPR conference held at Mont Tremblant, Quebec, in December 1942. The CIIA's activities during this period revealed the porosity and imprecision of the boundaries in Canada between the state and non-state realms. Throughout World War II, DEA and other Canadian government representatives attended CIIA and IPR conferences as “official non-officials,” effectively cooperating with private individuals in a network of purportedly non-governmental organizations that enabled Canada to exert leverage on the British government, reject British leadership, align itself with the United States, and secure a greater world role. CIIA leaders and Canadian officials also consciously encouraged nationalist forces in India, China, and Southeast Asia that sought to reject colonial rule and Western dominance. CIIA activities thus became part of a web of diplomatic interactions across a transnational network of think tanks within and outside the British Empire that had their own impact upon international affairs. 相似文献

The legitimacy of legal authorities – particularly the police – is central to the state's ability to function in a normatively justifiable and effective manner. Studies, mostly conducted in the US and UK, regularly find that procedural justice is the most important antecedent of police legitimacy, with judgments about other aspects of police behavior – notably, about effectiveness – appearing less relevant. But this idea has received only sporadic testing in less cohesive societies where social order is more tenuous, resources to sustain it scarcer, and the position of the police is less secure. This paper considers whether the link between process fairness and legitimacy holds in the challenging context of present day South Africa. In a high crime and socially divided society, do people still emphasize procedural fairness or are they more interested in instrumental effectiveness? How is the legitimacy of the police influenced by the wider problems faced by the South African state? We find procedural fairness judgments play a key role, but also that South Africans place greater emphasis on police effectiveness (and concerns about crime). Police legitimacy is, furthermore, associated with citizens' judgments about the wider success and trustworthiness of the state. 相似文献
