In parliamentary systems of government, parliaments can be conceptualized as central power-distributing institutions and as principals of the cabinet and other external officeholders. Relying on the principal-agent framework, this paper shows that electoral powers of parliaments can reduce agency loss and indicate a deviation from the ideal typical chain of delegation in parliamentary systems. Electoral powers of parliaments can be used to assess the degree to which cabinets are indeed constrained by external officeholders, whose constraining effect is often simply assumed. Empirically, the paper offers the first systematic comparative study of electoral powers of 25 European parliaments with regard to seven state offices. The analysis reveals major differences between parliaments and identifies electoral powers as an empirically distinct dimension of parliamentary power resources.  相似文献

Das Wirtschaftsprivatrecht ist von professionellen und planenden Akteuren beherrscht, die zur Minimierung der Transaktionskosten auf die weitestm?gliche Vorhersehbarkeit und Durchsetzbarkeit der Rechtslage angewiesen sind. Das entspricht nicht dem Blickwinkel des Richters, der nach Einzelfallgerechtigkeit in einem Rechtsstreit zwischen zwei konkreten Parteien strebt, aber auch nicht der begleitenden Wissenschaftler, die schon aus Gründen der Profilierung im wissenschaftlichen Umfeld zu innovativen und nicht selten gesetzesfernen Konzepten neigen. Der folgende Beitrag pl?diert daher für einen judicial und academic self-restraint, der sich unter Berücksichtigung der überindividuellen Auswirkungen um eine ermessensund beweisarme Rechtsatzbildung bemüht. Umso mehr sollte sich auch der Gesetzgeber des Postulats der Rechtssicherheit im Sinne der Rechtsklarheit, -stabilit?t und -durchsetzbarkeit und vor allem auch im Sinne der Vorhersehbarkeit richterlicher Entscheidungen wieder st?rker bewusst werden.  相似文献

How can we explain institutional reforms that redistribute institutional power between the parliamentary majority and minority? This paper proposes an informal theoretical model to explain such reforms in European parliaments based on congressional literature and inductive explanations from case studies. The article argues that political parties as the relevant actors pursue institutional reforms based on their substantive goals, their current and expected future government status, transaction and audience costs of reforms, second-order institutions that regulate the relative influence of actors in changing parliamentary rules, and the institutional status quo. Hypotheses derived from this model are tested with a qualitative case study of all standing order reforms in the Austrian parliament from 1945 to 2014. The empirical analysis finds support for various hypotheses and their underlying causal mechanisms. As Austria constitutes a least-likely case, the evidence provides strong support for the theoretical model.  相似文献

A progressive piece of legislation in 1993 granted collective land rights to Colombia's black communities living in the rural areas of the Pacific coast region. This measure aimed partly to support sustainable development strategies in the region through territorial empowering of local communities. Yet 14 years later, the escalation of the country's internal conflict into the Pacific region has created unprecedented levels of forced displacement among rural black communities. Once referred to as a ‘peace haven’, the Colombian Pacific coast is now characterised by new spaces of violence and terror, imposed by warring guerrilla and paramilitary groups, as well as the armed forces. This article examines the nature of the externally induced violence in the region and shows how specific economic interests, in particular in the African Palm sector, are colluding with illegal groups that are used to spread fear and terror among local residents, to make them comply with the requirements of these economic actors.  相似文献

Questions of institutional change have recently received increased attention in comparative politics. Even though comparative legislative research has identified important effects of parliamentary rules on processes and outputs as well as large variation across countries, we know very little about changes in these rules. This article takes several steps towards mapping and explaining rule changes in European parliaments. Theoretically, it sketches a model explaining such changes based on the rational choice notion of institutions as endogenous equilibria. Methodologically, it proposes two complementary approaches to measure rule changes. In combination, these measures allow us to identify the content, relevance, and effects of changes in parliamentary rules. Empirically, the article provides the first systematic analysis of all changes in the parliamentary standing orders of Austria, Germany, and Switzerland since 1945. This analysis demonstrates that parliamentary rules are changed frequently and massively. It also identifies differences across countries and content areas that are largely in line with theoretical expectations.  相似文献

Recent work on coalition governance claims that government parties use the chairs of parliamentary committees to ‘shadow’ ministers and thus to monitor coalition partners. This argument rests on the assumption that committee chairs enjoy special powers to extract information from ministries and to affect policy-making in committee. To test this assumption, the paper develops the first comparative measure of committee chair powers in fifteen Western European democracies. The analysis shows that most committee chairs have very limited formal powers and that the share of shadowing chairs does not increase when committee chairs are more powerful. Both findings cast doubt on the interpretation of shadow chairs as a monitoring device. We sketch an alternative explanation according to which coalition parties employ the shadowing strategy in order to increase public visibility and to counteract issue ownership by the minister’s party.  相似文献

Die Zerschneidung und Verinselung der Landschaft durch Infrastrukturanlagen wie Stra?en und Bahnlinien ist neben der direkten Zerst?rung und mechanischen Sch?digung des Lebensraumes eine der Hauptursachen für den Arten- und Lebensraumschwund. Die Bundesregierung hat sich deshalb in ihrer Biodiversit?tsstrategie zum Ziel gesetzt, bis zum Jahr 2020 die ?kologische Durchl?ssigkeit von zerschnittenen R?umen und bestehender Infrastruktur zu erreichen. Sie erarbeitet dafür derzeit ein Bundesprogramm zur Wiedervernetzung. Der vorliegende Beitrag untersucht die M?glichkeiten zur Berücksichtigung der Landschaftszerschneidung in der Bundesverkehrswegeplanung sowie die Konzipierung von Wiedervernetzungsma?nahmen aus rechtlicher und planerischer Sicht.  相似文献
