In this short piece, I set out briefly what we know about the challenge of diversity in the legal academy from existing scholarship. That field, in the UK at least, is sparse. I then go on to present a snapshot of the legal academy using data from the Higher Education Statistics Agency (HESA). I do this as the start of a much larger project on diversity and the legal academy that I plan to undertake over the next year. My argument is rather simple. The diversity of the legal academy reflects neither the diversity of our law student bodies nor the diversity of the wider population. Such diversity is vital for a number of reasons. My hope is that this piece can be the start of a dialogue on an important and largely ignored topic, and that further research will be done in this area.  相似文献

The Bar of England & Wales, like the wider legal profession, does not reflect the society it serves. The current data published by the Bar Standards Board (BSB) suggests a profile in relation to gender and ethnicity that gives serious cause for concern. As regards additional diversity characteristics, the BSB (and others) have accepted that the existing datasets are not wholly reliable because of poor response rates to associated diversity questionnaires. In 2011, the Legal Services Board (LSB) introduced mandatory guidance that obliged its daughter regulators to put into place rules that relate to diversity monitoring and reporting across the legal profession. This paper is concerned with how the BSB has operationalised that statutory guidance in respect of the Bar. Drawing on data gathered from the websites of 160 chambers, I show significant non-compliance with the reporting rule, and question both how the BSB itself reports on diversity data and the drafting of the reporting rule. I ask whether non-compliance is partly a function of the complexity seen in how the BSB has made operational the LSB’s reporting requirements. My data also suggests that the BSB should target its enforcement and educational approaches to the reporting rule to small and medium sized chambers.  相似文献

The sociology of organizations offers conceptual tools that can be used bycriminologists. The logic of crossing intra-disciplinary boundaries to borrowconceptual tools rests in the analogical properties of structure and processacross social settings that are fundamental aspects of all social organization.Analogy itself is underrecognized and used as a tool for conceptual thinkingand analysis in sociology. In this article, I give examples of theories andconcepts from the sociology of organizations that can usefully be appliedto substantive criminological problems. Then I compare family violence andcorporate crime as examples of organizational misconduct, foregroundingthe organizational setting in order to examine links between micro-, meso-,and macro-levels of analysis. These two exercises demonstrate thatincorporating organization theory into criminological research can providenew insights in data analysis of substantive problems, build toward generalsociological theory, and toward integrative general criminological theorythat escapes the levels of explanation problem.  相似文献

‘Public service motivation’ (PSM) is usually reported as a bright force although recent debate alludes to a dark side. Variables representing each side are, respectively, job satisfaction and burnout. This study tests for both the bright and potential dark direct effects of PSM and responds to calls to further validate the international PSM instrument developed by Kim et al. ( 2013 ). Using a sample of 455 local council workers in Australia, analysis confirmed that while the measure was robust and generalizable in its structure, none of the dimensions of PSM were found to influence either job satisfaction or burnout. Plausible explanations include contextual factors, nomological concerns with the measurement instrument, and the notion that PSM has a non‐significant influence on either. The implications of these findings are discussed and future research proposed.  相似文献

The purpose of this study was to examine the relationships among Chinese American adolescents’ discrimination experiences, cultural orientations, and delinquent behaviors. Data were collected from three hundred and eleven Chinese American adolescents (58% girls) and their parents when the adolescents were 7th or 8th graders and again 4 years later. The data analyses demonstrated that adolescents’ perceptions of discrimination and victimization experiences were significantly related to their delinquent behaviors conditionally based upon their cultural orientation. Specifically, adolescents’ high Chinese cultural orientation amplified the negative impact of discriminatory experiences on delinquent behaviors whereas high Western cultural orientation protected them against that impact. The significance of both ethnic and mainstream cultural orientations for understanding ethnic minority adolescents’ adjustment and improving their adjustment outcomes is discussed.  相似文献
