跨语言和文化教学研究--在全球化背景下教育亚洲法律专业学生所面临的挑战

在过去的十年里,亚洲赴澳大利亚接受高等教育的学生人数几乎翻了一番.对于澳大利亚法律教育工作者来说,所面临的挑战是如何精心设计课程、讲授课程,使学生通过学习这些课程,掌握一些处理涉及全球复杂法律问题的方法;教师在讲课时如何尽可能地注意所讲课程的相关度,使学生获益最大.这就要求设计者采用多学科的、国际化的方法来设计课程.本文试图从教育工作者的视角,分析这些挑战,并通过教学中的两个实例,来探讨向亚洲学生讲授法律课程的教学方法,指出存在的问题,提出改进措施.     

Trafficking in persons report

The Department of State is required by law to submit a Report each year to the U.S. Congress on foreign governments' efforts to eliminate severe forms of trafficking in persons. This Report is the sixth annual TIP Report. It is intended to raise global awareness, to highlight the growing efforts of the international community to combat human trafficking, and to encourage foreign governments to take effective actions to counter all forms of trafficking in persons.     

对中国民法学学术路向的初步思考——过分侧重制度性研究的缺陷及其克服

我国以往的民法学研究,呈现出的特点之一就是过分侧重制度性研究。这一研究模式有其存在的必要性,同时也存在一定的缺陷。未来的制度性研究应当是采用了体系化思考方法的制度性研究,应当是面向其他学科的研究方法和研究成果开放的制度性研究,而非单纯采用法律的逻辑分析方法的制度性研究。

Corporate health benefits and the indexing of the personal income tax

This note focuses on the role of the personal income tax in reducing the effective price of health care benefits. Tax-bracket creep is shown to provide a cushion that absorbs relatively large increases in health benefit costs, thus reducing the impetus for employer initiatives to control health care costs. It is hypothesized that the Economic Recovery Tax Act of 1981, with its provision for the indexing of tax brackets, will increase employer concern, and may therefore spur the development of effective employer initiatives to reduce the costs of health benefits.     

UK Ministerial Responsibility in 2002: The Tale of Two Resignations

The resignations in 2002 of Stephen Byers and Estelle Morris (UK Secretaries of State for Transport and Education respectively) suggest the need to review the constitutional and political aspects of resignation. In both cases, ministers recognized that they had failed in the oversight or supervision of their departments and thus in the fulfilment of their ministerial role. Their resignations therefore provide evidence of a move away from 'causal responsibility', with its complication of the policy/operations and accountability/responsibility distinctions, towards 'role responsibility'. In so doing, they raise the possibility that what are commonly understood as 'departmental fault' resignations may be more appropriately subsumed within an expanded category of personal fault. The resignations also challenge Finer's thesis on the conditions that need to be meet for a resignation to be forthcoming. In neither instance was the political party out for blood or the prime minister unbending. In both cases the press was relentless, suggesting that the media has become a prime actor in determining resignation, and the minister yielding, a recognition, perhaps, of constitutional principle over political pragmatism.

一、问题提出洗钱及防范对策知晓度是指人们对洗钱概念、特征及防范对策等相关内容的认知了解程度。其中,根据主体的不同,可以大致将这里所说的人们划分为两类,一类是与反洗钱工作直接相关的人员;另一类则是普通公众。其中,与反洗钱工作直接相关的人员主要包括金融机构履行反洗
