Abstract. It does not appear, at this time, that the average citizen's position vis-á-vis federal administrative agencies has been improved under the Federal Court Act (1970). For one thing, as might be expected, the Act does not require boards, beyond the rules of natural justice, to conduct their hearings according to certain minimum standards of procedure. In addition, it attempts to prohibit a role Canaidan courts have claimed to review the decisions of boards and commissions that are administrative in nature. Of course, in non-discretionary matters the prerogative writs are still available, although original jurisdiction in their issuance has been given exclusively to the itinerant Trial Division of the Federal Court. Under the Act, the Federal Court of Appeal is given original jurisdiction to review and set aside judicial or quasi-judicial decisions on certain grounds. But two of the grounds are substantially similar to those on which the prerogative remedies are issued. The final ground must await judicial interpretation for clarification. Its loose wording permits numerous possibilities for construction. If given a broad interpretation, certain expert and impartial boards will be, in effect, superseded in much of their decision-making power by the Court of Appeal. Sommaire. Throughout more than fifty years, the Cuban Revolution has been unable to implement an Economic Management System (ems) to face and overcome the traditional problems of centrally planned economies. When Cuban leaders tried to back away from the planning methods adopted in socialist countries, the economic management suffered from “voluntarism”, with invariably negative consequences. This article proposes a categorization of the economic cycle into upward phases –in which rational economic planning and organization predominate– and downward phases with a highly centralized direction of the economy. A historic-economic analysis of each phase of the cycle is presented, revealing that upward phases were characterized by good or acceptable economic outcomes, while these were poor during downward phases with a prevalence of voluntarism, unless external factors appeared. 相似文献

Bacterial infections are considered to be a major cause of sudden deaths. The recognition of infections caused by Neisseria meningitidis is an essential duty of medicolegal offices due to the risk of secondary cases. Since other microorganisms, such as Haemophilus influenzae and Streptococcus pneumoniae, are also involved in infectious sudden deaths, the identification of the pathogen responsible for death is essential in order to establish a positive diagnosis while also preventing secondary meningococcal cases. However, because of the unreliability of culture methods used for autopsy specimens and the fragile nature of the microorganisms, other techniques were used. In this study, the detection of specific antigens of N. meningitidis (serogroups A, B, C, Y and W135), H. influenzae type b, S. pneumoniae and Group B Streptococcus was undertaken in 40 samples from sudden death cases in legal procedures with a latex agglutination test. In addition, a meningococcus polymerase chain reaction (PCR) assay (ctrA, crgA and siaD genes) was also used as a corroboration method for positive N. meningitidis agglutinations. Eleven cases of sudden death were confirmed to be due to meningococcus while one case was confirmed to have been caused by H. influenzae type b fulminant epiglottitis. Rapid laboratory diagnosis of meningococcal infection allowed contacts management and notification to the health authorities. From the point of view of the authors, forensic diagnosis of unascertained deaths should include latex agglutination and meningococcus PCR when a fulminant infection by N. meningitidis or H. influenzae is suspected as well as in deaths where the cause is unclear. 相似文献

The study, using the recent contrasting experience of budget reform in Malaysia and Australia, inquires why quite similar changes were attempted in different socio-economic and fiscal settings. It explains why their implementation differed and identifies the factors that shaped, sustained, or impeded the respective efforts.
Three basic themes emerge. First, political and administrative will are necessary requirements for the success of any budget reform effort. Second, the more correspondent the bureaucratic culture is with the culture upon which the new budget system is premised, the more easily change occurs. Third, a model of reform predicated upon the assumption of fiscal restraint cannot effectively function in a climate of fiscal relaxation. Malaysia adapted its budget model from the Australian system. Short tandem repeats (STR)s have been the eligible markers for forensic animal genetics, despite single‐nucleotide polymorphisms (SNP)s became acceptable. The technology, the type, and amount of markers could limit the investigation in degraded forensic samples. The performance of a 32‐SNP panel genotyped through OpenArraysTM (real‐time PCR based) was evaluated to resolve cattle‐specific forensic cases. DNA from different biological sources was used, including samples from an alleged instance of cattle rustling. SNPs and STRs performance and repeatability were compared. SNP call rate was variable among sample type (average = 80.18%), while forensic samples showed the lowest value (70.94%). The repeatability obtained (98.7%) supports the used technology. SNPs had better call rates than STRs in 12 of 20 casework samples, while forensic index values were similar for both panels. In conclusion, the 32‐SNPs used are as informative as the standard bovine STR battery and hence are suitable to resolve cattle rustling investigations. 相似文献

In the 1980s and 1990s, the confluence of the third wave of democracy, neo-liberal economic reforms and economic crises in Latin America, produced several significant consequences for the region's underdeveloped interest group systems. By using an international political economy approach, this article examines these developments and particularly how neo-liberal policies affected the political fortunes of big business plus the broader political fall-out from neo-liberal policies. In essence, we make the argument that, for three reasons, the consequences of the confluence of these three developments for Latin America's emerging interest group system are mixed in terms of a more pluralist, open-access system. First, the influence of big business persists and in many ways has been enhanced as the economically and politically privileged position of large private companies since the 1980s has given way to economic concentration, transnationalization and the rise of multilatinas (Latin American multinational companies, which primarily operate across the region). Second, political opportunities have been opened for a range of interests, many from the left, that likely would not otherwise have emerged so early in the region. Third, the election of leaders opposed to neo-liberal policies may transform Latin America's political economy and aid in the democratization of its interest group system. Assessing risk markers in intimate partner femicide and severe violence: a new assessment instrument

The aim of this study is to develop a scale to predict intimate partner femicide and severe violence. The sample consists of 1,081 batterer men who were reported to the police station. First, the most significant differences between the severe violence group (n = 269) and the less severe violence group (n = 812) in sociodemographic variables are determined. Both aggressors and victims of the severe violence group have a higher rate of immigration. Second, the proposed 20-item scale is derived from a larger 58-item scale, where only the most discriminative items between severe and nonsevere intimate partner violence are taken into account. Psychometric properties of reliability and validity are rather good. Cutoff scores have been proposed according to sensitivity and specificity. This easy-to-use tool appears to be suitable to the requirements of criminal justice professionals and is intended for use in safety planning. Besides the dominant necrophagous dipteran of the families Sarcophagidae and Calliphoridae usually used for post mortem interval (PMI) estimations, species of other families such as Fanniidae have frequently been reported in forensic studies. Though less abundant, these species are prevalent in decomposing carcasses with most reports being anecdotal. In this study we identified adults of the fly family Fanniidae associated to pig carcasses located under different local environmental conditions (sun and shade) in a semiarid area at Mendoza, Argentina during the winter season. We examined the potential of species of this family as indicators of PMI by measuring abundance, time of occurrence and residency time at the carcasses. We identified six species of Fanniidae: Euryomma peregrinum Meigen, Fannia albitarsis Stein, Fannia femoralis Stein, Fannia fusconotata Rondani, Fannia heydenii Wiedemann and Fannia sanihue Domínguez and Aballay. Overall, fly abundance was higher at the sunlit than at the shaded carcass. The most abundant species at the sun was F. fusconotata while at the shaded carcass F. femoralis was the most abundant species. Based on their residency time, however, species with higher potential as PMI indicators seem to be F. heydenii and F. sanihue as their residency time at the carcass was restricted to a short period of the decomposition process. Other species were present throughout most of the decomposition process or in such a low abundance (E. peregrinum) that they were not useful as indicators. These preliminary results indicate that adults of some species of Fanniidae could act as a good complementary indicator species during the winter season. In particular, F. heydenii and F. sanihue should be the focus of further studies which should also expand to other seasons. 相似文献
