以科学发展看待人权保障——基于发展的人权路径分析

发展与人权是联合国的两大宗旨,二者有着很大的关联性.但发展与人权长期以来处于"并行"状态,在各不搭界的轨道上运行,造成了一系列问题.世界各国积极探索人权与发展的结合之路,提出"发展权"概念,以期解决人权与发展并行带来的问题.但发展权容易使人专注于发展的"权利性",而忽视人权的"义务性与责任性",造成盲目发展,带来一系列新的问题.在发展权前冠以"科学性",提出科学发展权,能把人权的权利性与责任性双双凸显,避免盲目发展所带来的问题.科学发展权具有形式性价值与实质性价值,是人权与发展结合的新境界.
