Governing Climate Change in China and Brazil: Mitigation Strategies

This article analyzes governmental responses for the climate change challenge in China and Brazil. Both countries have a central role in the climate change debate since they are major greenhouse gases emitters, thus contributing to the aggravation of the problem, each with differentiated participation. At the same time, policy measures aimed at climate issues in these countries may lead to the reconfiguration of international negotiations on the topic. The methodological aspects include three main points of analysis: the trajectory of greenhouse gas emissions in both countries; political and institutional structures mobilized to the climate issue and focusing on mitigation and policy responses related to climate change.     

Informational efficiency,organisational development and the institutional linkages of the provincial people's congresses in China

The Provincial People's Congresses (PPCs), Chinese legislatures at the provincial level, were resumed and their Standing Committees were established in the late 1970s after a decade of political chaos during the Cultural Revolution. In their early development, the survival and maintenance of the PPCs were threatened by the information impactedness, resulting from their structural detachment from both the National People's Congress and ordinary citizens, among many severe challenges. This article probes how, in the last two decades, the PPCs have pursued a network strategy and developed a complex of institutional linkages with other power institutions and societal forces. Taking advantage of these networks, the PPCs have woven their own information networks and dramatically enhanced their ability to collect, process, and disseminate information, both from the central leadership in Beijing, and from deputies and ordinary citizens at the grassroots. They also could have played a new role, ‘information broker’ between both sides. As a result of informational efficiency and rationality maximisation in decision‐making, the PPCs have become more institutionalised and been expanding their power to the extent that they have already been power players with weight in Chinese sub‐national politics.     

公证服务能力建设之我见

公证服务现阶段的主要矛盾在于公证服务能力未能满足公证当事人日益增长的公证需求。首先是缺少法律强制公证事项,公证服务被动且消极;其次缺少法律对公证证明标准的规范,而认定公证证明责任的不确定性增加公证执业风险;最后,现代化办证系统利用不充分、人力资源短缺、信息核实渠道单一等影响公证服务能力。为解决现阶段公证服务能力问题,应从以下几个方面着手:首先需要争取上级主管部门的支持,打破行政管理壁垒,发挥公证服务能力。其次,突破传统方法,以现代化手段宣传普及公证法律知识,及时了解当事人的公证需求。最后,建立一站式对外信息交流互助平台,为当事人提供自助查询、互助交流的便利。     

海检院检察建议工作调查报告

海淀检察院2003年至2007年发出各类检察建议共计346篇,通过涉及案件的罪名性质、接受检察建议单位的类别、检察建议内容的分类等方面的调查表明,检察建议工作取得了很大成效:检察建议的回复率逐年攀升;检察建议工作日趋规范化;形成了以检察建议为裁体,相关业务部门和职务犯罪预防部门协调配合的工作机制;检察建议的实效性日益突出.同时也存在一些问题,需要通过提高检察建议的法律效力,强化检察建议的针对性和操作性,增强检察建议的执行力以及加强回访考察等.促进检察建议取得实效.     

对创新兵团社会管理体制的思考

随着兵团各项改革的进一步深入，兵团经济体制深刻变革，社会结构深刻变动，利益格局深刻调整，思想观念深刻变化。这种整体性、全局性的社会变革，给兵团传统的社会管理方式带来了种种挑战和压力。为推进兵团经济社会的和谐发展，创新社会管理体制、整合社会资源、提高社会管理服务水平势在必行。
