论销赃罪的处罚

销赃罪是赃物犯罪的一种,该罪不但自身存在较大的危害性,其对本罪的刺激和帮助作用也是巨大的。但我国《刑法》仅对之规定了较低的法定刑,起不到应有的威慑作用。笔者认为,应提高销赃罪的法定刑,以加强对该罪的打击力度。     

Entpreprenerial Universities and Technology Transfer: A Conceptual Framework for Understanding Knowledge-Based Economic Development

This paper offers a framework to illuminate the role of universities in systems of innovation. The framework attempts to incorporate economic, social, and political influences that affect the ability of universities to both create new knowledge and deploy that knowledge in economically useful ways and thereby contribute to economic growth and prosperity. The objective of this paper is to build a more general understanding of university–industry relationships and their role in knowledge-based innovation systems.

20世纪80年代以来,埃及的高等教育不断加大开放力度,具体表现为:1.吸引外国政府和大学到埃及办学。十月六日城大学已成为埃及规模最大的国际化私立大学:2002～2003学年,该校14个系共有注册学生1.67万人(来自亚、非、欧、美四大洲的不同国家)。埃及科技大学实行三学期制,可授予文理学士、文理硕士和哲学博士学位,2002～2003学年,注册学生达9700多人。开罗德国大学作为德国创建的第一所境外大学,校园按照乌尔姆大学校园的风格模式建造;课程安排则与斯图加特大学和乌尔姆大学合作设置。2005年4月24日,中国与埃及有关创建埃及中国大学的合作协议…     

医患纠纷案件增多的原因及对策

医患关系本应是和谐相处的关系，医护人员对患者悉心诊治，患者放心地把自己的生命健康寄托于医院。然而，近年来医患纠纷案件却呈现逐年上升的趋势。而发生在哈尔滨医科大学第二附属医院收取550万余元天价医药费的事件，在充分暴露医疗卫生体制弊端的同时，显然加剧了医患之间的矛盾。为此，笔者对江苏省丰县人民法院十多年来审结的48起医患纠纷案件进行了调查和分析，以期寻求解决医患纠纷案件增多的对策。     

The use of phosphate buffered saline for the recovery of cells and spermatozoa from swabs.

In the forensic science laboratory, the recovery of spermatozoa from vaginal swabs, or vaginal cells from penile swabs, can help determine if sexual intercourse may have taken place. There are several methods used to recover spermatozoa and cells from the swabs before visualisation on a microscope slide and most of these methods use water. Phosphate buffered saline (PBS) is a non-toxic solution used in many biological laboratories. Unlike water, PBS prevents cells rupturing or shrivelling up due to osmosis. This study demonstrates that PBS can be used for the extraction of spermatozoa and cells from swabs and that PBS does not affect subsequent DNA profiling.     

Is it a fair deal to tell tales on the tabloids?

Legal context. A recent High Court judgment, Fraser-WoodwardLimited v BBC and Brighter Pictures Limited, is of key interestto those that use or advise upon the use of copyright materialfor the purposes of criticism or review. Key points. This case involved the use of newspaper photographsof David and Victoria Beckham in a television documentary aboutthe relationship between celebrities and the press. The programmeillustrated its theme using screenshots of tabloid newspaperpages, which inevitably included a number of photographs. Theclaimant was the copyright holder in respect of a number ofthe photographs, and alleged that their reproduction in theTV programme was an infringement of copyright. The defendantssuccessfully relied upon the fair dealing and incidental inclusiondefences to copyright infringement. Practical significance. Although each fair dealing case willultimately turn on its own facts, Mann J gave a very usefulreview of the state of copyright law in this difficult area.     

Is Taipei an Innovative City? An Institutionalist Analysis

This paper explores whether Taipei is an innovative city by critically examining Taipei’s industrial and economic performance, developmental visions and spatial planning, as well as institutional settings and political contexts. With the aid of institutionalist perspective, the author argues that Taipei’s innovative efforts are mostly policy innovation, rather than institutional innovation. The author also describes the institutional dynamics that have caused the lack of Taipei’s institutional innovation. The case study of Taipei could be helpful in conducting comparative studies on urban innovation.

霍华德政府的"均衡"外交政策,是世纪之交澳大利亚政府外交政策的一个显著变化.霍华德四次执政,其"均衡"外交政策的成效是重要因素之一.本文试从当代澳大利亚外交的两大支柱--澳美关系和澳亚关系的角度,评述霍华德政府均衡外交政策的基本内容、发展演变的特点和原因及所面临的问题,并在此基础上,解读未来澳大利亚均衡外交的走向.

随着中国市场经济体制和行政体制改革的不断深入,城市中传统的纵向单一性社区结构逐渐向横向多元性结构转变.传统单位型社区向新型社区转型过程中,单位介入力量的逐步减弱引发社区中传统社会支持网络的衰落.文章分析了传统单位型社区的社会支持模式,探讨了新型社区社会支持网络重构过程中需要解决的问题、所面临的困难以及可资利用的资源.
