浅析广西与东盟文化产业的交流与合作

中国与东盟都重视文化产业的发展,积极开展双方文化产业交流合作。广西在参与中国-东盟自由贸易区建设中具有得天独厚的优势,这在一定程度上推动广西走上国际文化交流的前沿。本文主要分析广西文化产业的发展现状、存在问题及广西在中国-东盟背景下的文化产业交流与合作的优势及前景。     

刑民交叉案件处理的宪法路径

刑民交叉案件带来的法律适用困境,看似是刑法与民法的冲突,实则是宪法层面上刑法与民法的范围确立之争.尽管刑法与民法的目的 都是为了保障公民在宪法上享有的权利得以充分落实,但是两者之间的界限并不易确定,法律实践存在把民事纠纷拔高为刑事犯罪的问题.刑民冲突的本质是对公民的基本权利与限制基本权利的公权力的关系探讨,最终是宪法层面的问题,刑法理论以往有关刑民交叉处理模式的讨论忽视了这一最终问题.比例原则作为宪法性原则,为刑民交叉案件的处理提供了思路,处理刑民交叉问题,当以比例原则的三个子原则为审查标准,对刑法介入的正当性进行检验和论证,防止刑法的不当扩张侵犯了公民的基本权利.
