The new constitutions of east Germany

The restoration of the Lander in the former GDR in 1990 and the unification of Berlin called for a round of constitution drafting in the east that resulted in considerable discussion and controversy within the attentive public and, especially, among legal scholars in all of Germany. Controversy focused on two general issues: direct democracy and certain constitutional provisions such as social rights and state goals. Direct democracy is nothing new for the Länder, since most West German Land constitutions provided for referenda long before the Wall collapsed. But the three‐step process adopted in the east, and in particular the relatively low signature requirements for initiatives and petitions, both of which were in fact first introduced by Schleswig‐Holstein in 1990, did not meet with universal approval. Even more controversial were certain provisions in the Land constititions, for example, Brandenburg, that probably violate the Basic Law, and a number of unenforceable social rights and state goals that raise questions about feasibility and false expectations. This leaves us with questions about just how different from their western counterparts the constitutions in the new Lander really are and whether, given the relatively weak position of the Lander in the policy‐making process in the German federal system and the EU, their constitutional provisions matter that much.     

Race,Social Welfare,and the Decline of Postwar Liberalism: A New or Old Key?

Fifty-one years ago, when liberalism and social welfare democracy were expanding in all advanced industrialized nations, V.O. Key, Jr., forecast the decline of postwar liberalism in the United States. Current discussion of the decline of liberalism has ignored Key or, when evidence is lacking, has incorrectly cited him. In contrast to Key's relatively direct, simple, and heavily documented reasoning, current explanations are multifactorial, complex, less well documented, and often ideologically loaded. Some explanations for the postwar decline identify causal factors more than six years after the war, yet they ignore events in 1945–47. At the fifty-first anniversary of V.O. Key's Southern Politics in State and Nation, attention to Key's forecast and Occam's razor is called for. Key argued that racism in the South, exerted through congressional committees, would lead to a decline of liberalism in the nation. Using legislative histories, this article compares Key's single-factor racial explanation with a two-factor explanation—and by implication with multifactor ones—and finds Key's more compelling and parsimonious. Archival sources indicate that more than two years before the 1948 Democratic Convention, Charlie Ross, Truman's closest advisor, and Truman himself encouraged Key to assess the emerging postwar politics of the South. As Key anticipated, institutionalized racism sunk the Fair Deal and postwar social democracy, despite Truman's efforts. The effects of racism on postwar and current politics and public administration should be reexamined as a key to understanding American distinctiveness or exceptionalism.     

The catathymic crisis: An explanation of the serial killer

Various explanations have been proposed to explain the motivation of serial killers. This article proposes that the theory of the Catathymic Crisis is an explanation that adds light to the “serial” nature of serial murder as well as an explanation of why and how a person can become a serial killer. The theory of Catathymic Crisis was presented in 1937 by Dr. Frederic Wertham as an explanation for some types violent and seemingly motivationless crimes. Dr. Wertham's theory describes a five stage process in which (1) a thinking disorder occurs within the mind of the criminal, (2) a plan is created to commit a violent criminal act, (3) internal emotional tension forces the commission of the criminal act, which leads to (4) a superficial calmness in which the need to commit the violent act is eliminated and normal activity can be conducted and (5) the mind adjusts itself and understands that the thinking process that caused the commission of the criminal act was flawed and the mind makes adjustments in order to prevent further criminal activity. The serial killer never reaches the fifth stage but returns to the second and operates in a cycle between stage two and four. This article advocates that the Catathymic Crisis explains why the serial killer needs to commit murder, why that need develops and why there is an escalating nature of the criminal activity by the serial killer.

The relative success of private funders and government funders in funding important science

Regression analysis is used to test the effects of funding source (and of various control variables) on the importance of the article, as measured by the number of citations that the article receives. Funding source is measured by the number of private and the number of government grants mentioned in the acknowledgements section. The importance of an article is measured by an “early” count (of citations through October 1992), and a “late” count (of citations through July 2002). Using either measure of article importance, the evidence suggests that private funders are more successful than the government at identifying important research. Jel classification D 780 . H 110 . Public Administrative Science in Germany: Problems and Prospects of a Composite Discipline

German administrative science is composed of different disciplines which combine to form a multi- rather than an interdisciplinary science. Its roots can be traced back to the integrated policy-science ( Policey-Wissenschaft ) of the eighteenth century, which went through a process of differentiation during the nineteenth century. In German universities today, teaching and research is divided into different departments, a main problem being the disproportionate nature of this multidisciplinary structure. In German administrative science, a legalistic approach still predominates, although, in the 1960s and 1970s, political scientists played an important role in empirical research and theoretical discussions. Looking ahead, however, there is now an excellent chance that with the rise of the governance approach this asymmetric multidisciplinarity can be turned into a more balanced administrative science, even if it will remain a composite discipline.
