马克思实践自由观的演进及其意义

实践与自由在马克思实践哲学中是相互阐释的,所以人的自由只能存在于人的现实生活的此岸世界中,我们也只能从人的具体现实生存中探求人的自由,超越外在障碍,能动地自我实现、自我决定、自我创造,从而形成与自然、社会、历史规律的和谐统一.

Die Alpenkonvention und ihre Protokolle sind ein umfassendes multilaterales Vertragswerk, das auf den Schutz der ?kologisch sensiblen Alpenregionen vor den Belastungen durch Tourismus, Verkehr und sonstigen Nutzungen zielt. Der vorliegende Beitrag untersucht die Praxis der Anwendung der Protokolle der Alpenkonvention in ?sterreich, wo sich zu verschiedenen Einzelf?llen bereits eine Judikatur des Verwaltungsgerichtshofes entwickelt hat. Dabei gibt es wenige, aber doch spektakul?re “leading cases”.

新时期中国人才政策变迁分析——基于政策网络视角

基于政策网络视角的新时期中国人才政策变迁分析为中国人才政策变迁提供了新的解释力。改革开放以来,原有的社会利益格局被打破,多元的利益格局正在形成,基于不同的价值观念和利益偏好,形成了不同的利益集团。在人才政策变迁过程中,这些多元利益主体通过不断的互动,形成了具有不同特征的关系网络。拥有不同价值观念和利益偏好的网络主体通过博弈、联合、对抗与妥协,从而影响政策效果,导致了人才政策的持续变迁。     

试论消防应急救援中的行政协助

消防部队是消防应急救援中的骨干力量,除此之外还包括公安、水利、交通等多种力量共同参与救援。其中,公安等其他行政主体参与救援,应当是对公安机关消防机构实施的行政协助行为。新《消防法》中关于应急救援的协助行为并未作出规定,应当借助行政协助理论予以明确。     

Detection of gamma-hydroxybutyrate (GHB) in beverages

OBJECTIVE: To establish an analytical method for the determination of GHB in beverages using GC/MS and LC/MS/MS. METHODS: After beverage samples with GHB-d6 as the internal standard were extracted with ethyl acetate, then the extracts were derivatized with N,O-bis(trimethylsilyl)trifluoroacetamide (BSTFA), at last the derivateized extracts analyzed by gas chromatography- mass spectrometry. After beverage samples with GHB-d6 as the internal standard were diluted by mobile phase then directly analyzed by LC/MS/MS. Results The limit of detection was 0.2 microg/mL and both relative standard deviations for between-day and within-day assays were < 8.54% in GC/MS. The limit of detection was 2 microg/mL and both relative standard deviations for between-day and within-day assays were <8.62% in LC/MS/MS. Conclusion These methods of qualitative and quantitative analysis were found to be sensitive, accurate, rapid and suitable for the forensic toxicology to test of GHB in real cases.     

Neue Perspektiven der Gemeindezusammenarbeit? Die B-VG-Novelle BGBl I 60/2011 und ihre Relevanz für die interkommunale Kooperation

Die B-VG-Novelle BGBl I 60/2011 enth?lt einige wichtige Neuerungen in den verfassungsrechtlichen Rahmenbedingungen der interkommunalen Kooperation. Im Mittelpunkt steht dabei der Gemeindeverband als zentrale Institution der Gemeindezusammenarbeit in ?sterreich. Allerdings verdient auch das neu eingeführte Instrument der ?ffentlich-rechtlichen Vereinbarungen von Gemeinden Interesse. Der vorliegende Beitrag analysiert die neue Verfassungsrechtslage und prüft ihre Relevanz für die künftige Gemeindezusammenarbeit.     

鸭疫里氏杆菌病三价油乳剂灭活疫苗的研究

以 1、2、10型鸭疫里氏杆菌 (RA)分离株为菌种 ,研制鸭疫里氏杆菌病三价油乳剂灭活疫苗。经无菌及安全检验合格后 ,对 6日龄樱桃谷雏鸭颈部皮下接种 0 .4mL/只 ,免疫后第 10、14、2 1和 3 5d分别用 1、2、10型RA强毒株攻击 ,第 14d的攻毒保护率为 91.7%～ 10 0 % ,3 5d的攻毒保护率为 66.6%～ 83 .3 %。田间试验结果表明 ,雏鸭 5～ 7日龄免疫后至上市保护率可达 95 .0 %～ 10 0 %。     

刑事印证之研究

刑事印证具有证据的多数性、印证性、可重复检验性、客观稳定性和视野的整体性等特征,其实践形态有全面与部分印证、概括与细节印证、肯定与否定印证、普通与关键印证之分;证据间的合理差异不影响主要印证事实的认定,但需要查明差异的原因;可从四方面判断印证是否真实：是否存在刑讯逼供、指供诱供、串供情况、证据印证的具体情况、证据取得的具体程序、印证内容是否违反经验法则和逻辑法则;要善于发现关键印证,有效运用其在认定案件事实中的作用。
