保障当事人诉讼权利的基本课题

在司法文明指数报告中,考察当事人诉讼权利的基本思路,包括设计二级指标和测试题目两方面内容。通过分析指数报告,可以发现当事人诉讼权利的保障情况总体不佳。保障当事人诉讼权利,应当强调发挥法院的作用;而未来改革的基本课题,包括如何防止权力主体滥用自由裁量权,以及如何为权力主体依法行使职权提供必要的外部保障。     

Rethinking on China-U.S. Relations

In the quarter-century since the fall of the Berlin Wall in 1989, the former Soviet Union＇s disintegration in 1991 and the end of the Cold War,China-U.S. relations have supported the trend of development. The two countries extensively and intensively have engaged in dialogue, close personnel exchanges, unprecedented economic and trade relations, and bilateral coordination on intemational and regional issues. The bilateral relationship has profound influence over the two countries and the world but, while total confrontation and crisis is not on the horizon, there is no guarantee that their future disagreements will not become serious or intractable. In this past quarter-century, the U.S. has repeatedly used and threatened to use force against China, a sign that military conflict between them, even a local or relatively large-scale war, is not out of the question. The U.S. global strategy has not changed, the basic content and goals of the U.S. strategy towards China have not changed, and the nature of the China-U.S. relationship is yet to be defined.

Horses for courses: China's accommodative approach to food standard‐setting in response to the internationalization of regulation

This paper examines the evolution of China's food standard‐setting procedures from both domestic and international perspectives, particularly in the context of the internationalization of regulation. After the reform and opening‐up in 1978, state actors and leading enterprises monopolized the process of national food standard setting. With further participation in the global economy in the 21st century, China has become familiar with the international standard‐setting procedures and has modeled its domestic policymaking on these practices. This has resulted in a more transparent, inclusive, scientific, pluralized, and consensus‐based form of decisionmaking. By contrast, the standards of the strategic industries have been harmonized to the standards of international counterparts through a top‐down and authoritarian approach. This paper argues that China uses an accommodative approach, trichotomizing suitable standards and decisionmaking procedures in terms of inclusiveness and transparency, which suits the developmental needs of the domestic market, food export markets, and strategic industries.     

关于加强反腐倡廉制度体系建设的思考

加强反腐倡廉建设需要借助于科学的制度设计来实现,构筑完备的反腐倡廉制度体系是根本和关键.反腐倡廉制度体系应由独立权威的反腐倡廉机构、完善的反腐倡廉法规体系、完备的权力制衡机制以及严密的腐败惩戒机制组成.主体、保障、防御以及惩戒的有机统一构成反腐倡廉制馊体系的主线与灵魂.     

The social semiotic of homophone phrase substitution in Chinese netizen discourse

The paper addresses an ingenious way by which Chinese netizens manage to reach their intended audiences under the radar of censors surveying the Internet in China. One specifically Chinese social use of language in this respect is the option to express criticism by using inoffensive characters that share the same or similar pronunciation with politically sensitive phrasing. We identify this type of expression as homophone phrase substitution (HPS). The device has been part of Chinese since ancient times under the name political metaphor. We address the main constraints at work in HPS, especially the role of voice (prosodic contour) that guides the construction of two divergent kinds of aboutness. Leaving aside its critical function in contemporary society, by contrasting HPS with verbal irony, metaphor, and Australian rhyming slang, and by drawing on semiologie and semiotics, indirect speech acts and implicit deixis, we suggest that this linguistic option throws new light on the semantic/pragmatic distinction.     

Corporate policy entrepreneurship and cross-boundary strategies: How a private corporation champions mobile healthcare payment innovation in China?

The private nature of corporate actors does not necessarily preclude them from contributing to public interest. When business strategies and genuine public motivation are favorably aligned, corporate actors from the private sector can also drive public sector innovations. For a private corporation, policy entrepreneurship inherently entails crossing not only the public–private boundary but also various policy domains. This study formulates five propositions to characterize the cross-boundary strategies of corporate policy entrepreneurship, a distinct form of policy entrepreneurship in a developing authoritarian state. The case study of mobile healthcare payment innovation in China finds that the corporate entrepreneur used a series of cross-boundary strategies adeptly that eventually made the innovation not only adopted in one locality but also rapidly diffused nationwide. These strategies were not used in isolation or in a pure stepwise fashion but appeared to be recursive and interactive, suggesting the dynamic nature of corporate policy entrepreneurship in a multilevel governance system. More studies could be done to further examine strategies and processes of other forms of policy entrepreneurship in various national and sectoral settings.

社会养老保险：从“城乡全覆盖”到“城乡一体化”——以浙江省德清县为例

2009年国家新农保《指导意见》出台后，德清作为试点，在全县范围内初步建构起“城乡全覆盖”的格局，进而向“城乡一体化”方向发展。与“全覆盖”注重覆盖面的广度不同，“一体化”更强调社会养老保险的“保障基本”、制度衔接、“自由选择”、分类享受，突出对“公平”与“自由”的兼顾。德清县的实践经验启示社会养老保险制度应当突出“保障基本”力度和效果，增强政府责任，加大政府财政投入力度，提高城乡双向流动性，渐进地实现社会养老保险制度城乡一体化。
