De la rentabilité municipale des développements résidentiels

Sommaire: Dans cette analyse, la rentabilité fiscale de trente et un projets résidentiels construits au Québec entre 1971 et 1976 est calculée selon l'approche générale des analyses d'impact fiscal. Les particularités et limites méthodologiques des études d'impact municipal sont décrites et le modèle utilisé ici est présenté en détail. On peut utiliser les résultats à des fins de réquisitoire contre l'étalement urbain ou de plaidoyer en faveur de la densification du développement. Cependant, on ne devrait pas chercher à trouver dans ces résultats une condamnation globale de la maison unifamiliale, ni des arguments qui pourraient inciter les municipalités québécoises à abandonner leur fonction traditionnelle de maître d'oeuvre des infrastructures résidentielles. Abstract: The fiscal profitability of thirty-one residential developments which took place in Quebec between 1971 and 1976 is measured within the general framework of fiscal impact analysis. The characteristics and limitations of municipal fiscal impact studies are outlined and a specific model is described. The results could be interpreted as a strong argument against urban sprawl and in favour of more compact residential patterns. Nevertheless, these conclusions should not be overextended and construed as arguments against single family oriented projects or in favour of jettisoning the tradition of leaving to Quebec municipalities the responsibility of providing and financing urban services.

Zu den verfahrensrechtlichen Implikationen der Kompetenzverteilung zwischen der EG und den Mitgliedstaaten im Bereich der Außenbeziehungen

Grundsätzlich finden in Bezug auf die Kompetenzverteilung zwischen EU und Mitgliedsstaaten für die Verhandlung völkerrechtlicher Verträge und den Erlass von „Durchführungsbestimmungen“ im Rahmen völkerrechtliche Vertragsreihe die allgemeinen Grundsätze der Kompetenzverteilung im Bereich der Außenbeziehungen Anwendung. Diese sind aber mit Blick auf die spezifische Problematik von Verhandlung und Durchführung völkerrechtliche Verträge einer Reihe von Präzisierungen zugänglich, die im Folgenden entwickelt werden. Diese Fragestellung ist allgemein im Recht der Außenbeziehungen von Bedeutung; im Umweltbereich ist sie aber wegen der Fülle völkerrechtlicher Verträge der Gemeinschaft und ihrem Charakter als i.d.R. gemischte Verträge besonders relevant. Participation in Prison Activities: An Analysis of the Determinants of Participation

The positive associations of participation in prison activities (e.g. socio-cultural activities, educational courses, sports activities, vocational training, etc.), including reduction of recidivism, improvement of wellbeing and contributions to self-worth, are increasingly recognized. However, little is known about the characteristics by which participants differ from non-participants. In response to this research gap, this study aims to examine the determinants of inmate participation in prison activities. The determinants are categorized as outlined by the importation (individual characteristics) and deprivation (prison life characteristics) frameworks. Survey data derived from a research project in a remand prison in Belgium (N?=?486) provided the empirical evidence for the multiple linear regression analyses. The findings indicate that individual deprivation variables are more likely to predict participation. However, our findings also highlight that the combined effects of importation and deprivation characteristics are more powerful in explaining activity participation. The article concludes by discussing some paths for future prison research and implications for theory and practice. It provides impetus to organize and increase participation in prison activities, taking into account the diverse characteristics, needs and competences of the prison population.
