司法实践中的涉外法律适用问题初探

中国加入世界贸易组织对人民法院涉外民商事审判工作提出了新要求,需要建立适应WTO规则的涉外民商事审判制度,包括:建立适合世贸组织规则的审判运行机制;落实公开审判制度,增强审判工作透明度;准确适用法律,确保案件裁判的统一性;提高法官队伍素质,实现涉外审判专业化。     

An Investigation of Mental Health and Personality in Swedish Police Trainees upon Entry to the Police Academy

This study aimed at personality and mental health status of Swedish police trainees considering gender differences; and at relationships between personality and mental health. 103 individuals were investigated by means of the SCL-90-R and the Temperament and Character Inventory (TCI) upon entry to the police academy. By contrast, the police trainees were mentally much healthier than individuals from the general population. They reported low Harm Avoidance and their character dimensions were more developed in terms of strength, responsibility and reliability. Harm Avoidance (positively) and Self-Directedness (negatively) were found to be associated with all facets of psychopathology. The good mental health and mature personality characteristics reported by trainees, particularly the females, suggest that they have the strength to master the stressful situations which they will face in their professional lives. In order to prevent possible psychological disturbances later in life, due to the high level of distress in their work, the development of trainees’ personality in terms of particular coping skills should be regarded as an integral part of their professional training at the police academy.     

论“水权”概念在美国的界定

水权是我国学界研究的热点问题,但对其概念的内涵与外延却一直未有定论,这就需要我们回到“水权”概念的源头——美国,对其加以深入考察。根据美国学者和立法实践对于“水权”（waterright）的界定,水权是对流淌于天然通道的江河、湖泊、溪流、泉水、地下含水层等公共水体的权利,水权只是指水资源使用权或水使用权（包括水资源使用权和商品水使用权）,而不包括水资源所有权或水所有权。这是由美国所具有的法律文化、法律思维、法律理念、法律传统所决定的。     

论《农产品质量安全法》的性质及适用范围

近年来,我国农产品质量安全问题已成为社会公众关注的热点问题, <农产品质量安全法>的出台无疑对于解决农产品质量安全问题具有深远的意义,但对于该法的理解和适用还存在着诸多误区,严重影响了该法重要作用的发挥.因此,有必要明晰<农产品质量安全法>的性质及适用范围,以利于该法与<产品质量法>等法律划分管辖,避免重复管辖或者漏管.     

加强司法行政法制工作 为司法行政工作改革发展提供有力的法制保障

30年来,司法行政法制工作经历了一个从无到有、不断发展、不断强化的过程,大体上经历了四个发展阶段：一是法制工作起步阶段（1979—1984）。这一阶段,司法行政工作的部署和开展主要靠政策文件,立法工作尚未起步,法制工作处于摸索、初创的状态。二是法制工作初步发展阶段（1985—1992）。

主体意识形态对社会发展起着多方面的作用,是社会最重要的整合手段,是政治(政权)“合法性”的依据,它对社会活动的价值导向、社会心理的升华、社会生活方式的形成产生着重要影响。目前国际国内形势的重大变化对我国意识形态安全构成了严峻挑战,为此,要构建我国意识形态安全体系:一是加强意识形态政治性与社会性的有机结合,实现主体意识形态的内在化;二是增强意识形态安全意识,正确发挥意识形态的功能;三是主动参与文化全球化的过程,提高与多元意识形态长期相处共存的能力;四是在国际交往中既要超越社会制度和意识形态,又要充分警惕西方的西化、分化;五是在各种文化的交流碰撞中,主动维护我国的意识形态安全;六是发挥中国文化的辐射性功能,让世界了解中国,扩大我国意识形态的影响力。

“To This Day She Continues to Struggle with the Terror Imposed upon Her”: Rape Narratives in Victim Impact Statements

This study locates the victim impact statements of raped women in the sociolegal context of significant sentencing law reforms introduced in Canada to address an ascendant victim’s rights movement. We examine 38 reported sentencing decisions in sexual assault cases in Ontario, Canada (1999–2010). Our objectives are to discern (a) whether the archetype of the ideal victim continues to influence juridical discourse after conviction and (b) what narratives of harm intersect with sentencing objectives and aggravating factors. Our findings suggest women express profound fear of re-victimization and traumatic effects of sexual violence regardless of the relational context of their rape experience. Most surprisingly, our data show sentencing judges view the sexual assault of an intoxicated rape victim as an aggravating factor. Future consideration for victim impact statements in sexual assault cases is discussed.
