略论司法鉴定样本

司法鉴定样本是指从受审查客体中抽取的用于进行比对和分析的样品或标本.司法鉴定样本可以分为比对样本和分析样本两大类.司法鉴定样本的种类、数量以及收集样本的主体、程序和方法等,对鉴定意见的客观性和合法性都会产生直接或间接影响.要确保司法鉴定的客观性和合法性,收集和制作司法鉴定样本必须坚持同类性原则、重复性原则、相近性原则、充分性原则和合法性原则.     

论“党的建设质量”内涵体系的整体性把握

在加强党的建设已成为全党共识背景下,如何真正提高党建质量和成效,成为党建实践的关键。为实现"不断提高党的建设质量"要求,必须对"党的建设质量"内涵体系进行整体性认识和把握。整体性的党建质量内涵体系应包括全面系统的党建内容体系、科学准确的党建目标体系、完整有效的党建制度体系、严密健全的党建效果体系、科学完善的党建质量评价体系等"五位一体"的内涵构成。实践中要避免简单化、碎片化和形式主义的倾向,并且要落实到党的建设各个方面、贯穿于全面从严治党的全过程。     

Think territory politically: the making and escalation of Beijing’s commitment to Sovereignize Diaoyu/Senkaku Islands

In popular narratives, intellectual and media analysts believe the Diaoyu/Senkaku Islands dispute between China and Japan is a contestation for potential hydrocarbon reserves and other maritime rights which are per se divisible, but nationalism – particularly on China side – and relative power change between the two competing claimants make these territories increasingly indivisible and the dispute war-prone. Based on a review over People's Daily’s coverage of the disputes and other secondary information, this article reveals a different scenario by highlighting the political meanings of disputed territories for national cohesion and regime self-preservation. It finds, Beijing’s strategic moves in the disputes are influenced by its efforts at different occasions to de-legitimate Republic of China at Taiwan and defend its core interests – namely Taiwan and the "One-China" principle, to appease the patriotism in Hong Kong and facilitate the latter’s stable reversion to China in 1990s, and what is more, to rally popular support at home. In addition, Beijing’s Diaoyu/Senkaku strategy did not follow a carefully calculated path, but was mostly reactive to the contingencies and ultimately took shape through the incremental accumulation of previous policies and behaviours.     

中国工业经济绩效的实证研究——基于36个行业的面板数据

该文利用1993-2008年的36个工业行业的面板数据,通过固定效应模型,实证研究了工业行业的经济绩效与影响因素之间的关系。研究结果表明,提高工业行业的经济绩效关键在于行业效率和市场需求。从分行业的角度看,影响行业绩效的因素与生产型行业和消费型行业的行业特征有关。根据该文的研究表明,对于某些行业,试图通过兼并或重组等方式扩大行业规模、提高行业产值和行业集中度的做法来提高行业绩效,有可能适得其反。     

法律社会学的定位问题:Max Weber与Hans Kelsen的比较

德国社会学家韦伯(Max Weber,1864-1920)与奥地利法学家凯尔森(Hans Kelsen,1881-1973)对"法律社会学"(Rechtssoziologie,sociology of law)的定位存在异同。他们一个从社会学家的立场,一个从法学家的立场,探讨了"法律社会学"在19世纪末叶跟着社会学(Soziologie)一起诞生的时候,究竟应该如何对这新兴的学问加以定位的问题。他们两位都是法学家出身,同样受到当时哲学思潮新康德主义(Neukantianismus)的影响,主张划分"实然"(Sein)与"应然"(Sollen),也同样对促进德语世界法律社会学的诞生有积极贡献的"自由法学派"(Freirechtle-hre)与奥地利法律社会学家艾利希(Eugen Ehrlich,1862-1922)提出了批评意见,但是他们对于"法律社会学"这门新兴的学科,却还是有不完全相同的定位。

论我国人民代表大会对预算草案的审批权和修正权

我国现行人民代表大会预算草案审批权所存在的问题莫过于审批权对行政部门的实际约束力较低,无法起到限制和监督权力的作用,对此,应致力于预算程序、实体、效力三方面的完善。同时,我国人民代表大会预算草案修正权的法律规定也处于缺位状态,鉴于此,应致力于明确修正权权能和修正权行使方式两个方面进行构建。     

Human Fatality Due to Thallium Poisoning: Autopsy,Microscopy, and Mass Spectrometry Assays,

Thallium has been responsible for many intoxications since its discovery; however, toxicological profiles for thallium in human fatalities have not been updated recently. Autopsy, microscopic investigations, and toxicological analyses were performed on a married couple who died from thallium sulfate intended homicidal poisoning. The distribution of thallium was established by inductively coupled plasma mass spectrometry with hair samples showing the highest thallium concentration. Electron microscopy revealed a dystrophic condition of hair with disorganized cuticle and atrophy of the hair bulb. Thallium interacts with cells at different levels, with prominent ultrastructural injuries in the mitochondria and endoplasmic reticulum, and high concentration of electron dense granules observed in the cytoplasm and mitochondria of several organs. Alopecia, toxic encephalopathy, and peripheral neuropathy were diagnosed in the victims and suggested to be crucial implications for thallium poisoning. The analytical procedures used in this case are of considerable forensic importance in the diagnosis of thallium poisoning.

Infectious Diseases and International Security

The article discusses the relationship between epidemics and international security. It analyzes how human economic behaviors have broken the equilibrium of co-evolution, and examines the possible dangerous impacts of this upon human society. Finally, mechanisms of cooperation against pandemics at the governmental and grassroots level are listed. The authors argue that only by revising our conception of development and establishing an integrated understanding of global progress can we achieve international cooperation against epidemics.
