城市在职青年的就业途径及相关因素分析

基于全国12城市2537名在职青年的抽样调查资料,论文描述了目前城市在职青年实现就业的主要途径及其分布,并对相关因素进行了分析.研究结果表明,青年自己应聘就业的占一半左右,学校分配的约占20％,通过各种社会关系获得就业的约占25％.青年的城乡背景、青年参加工作时间、特别是青年的文化程度等因素对其实现就业的途径有明显的影响.

沉默权在中国的困境与出路——以《刑事诉讼法》修改为背景

备受期待的沉默权没有被写入刑事诉讼法,这是根据具体国情适当选择的结果.然而沉默权问题越来越受到人们的关注,特别是在我国加入《公民权利与政治权利国际公约》之后.因为立法传统的缺乏、价值观的冲突及侦查机关的反对,目前我国还不能确立沉默权,但沉默权出现在中国司法体系中是一种大趋势.在立法上确立沉默权,通过合理地运用证据推定规则和辩诉交易原则,进而在中国确立有限的沉默权,是沉默权在中国的出路.     

Wan Zhengwen： Champion of the Miao Wooden Drum Dance

Wan Zhengwen was born in 1951 in Fanpai Village of Taijiang County in Guizhou Province. Having learned the Wooden Drum Dance from a young age, he set ut） the Fanpai Village Wooden Drum Dance troupe at the beginning of the 1980s. He has led the ensemble ever since, putting on shows around China and abroad, and winning much praise from audiences. The ＂dancing king＂ of the Miao ethnic group has been named a national inheritor of the Wooden Drum Dance, which is now recognized as part of China＇s intangible cultural heritage.     

论《联合国海洋法公约》“海洋科研”条款的解释及效力

UNCLOS中尚存"灰色区域",没有对"海洋科研"、"军事测量"等词语进行界定,导致条款的不同解释和争端。主要原因在于其既是政治性协定又是法律协定。UNCLOS的大部分内容都相互联系并构成一个整体,为"一揽子交易"。美国并未批准UNCLOS,却常选择性援引相关权利条款,规避义务。根据《维也纳条约法公约》规定,第三方享有条约下的权利并非没有任何限制;第三方应受习惯国际法规则和强行法的约束;应根据VCLT来解释UNCLOS。应在整个国际法体系下理解条约对第三方的法律效力以及"海洋科研"条款的含义。

西部边境民族地区群体性事件发生后,需要公安机关及时疏导和教育群众,做好群众的解释工作,避免事态恶化、升级,期间的群众工作担负任务艰巨,涉及内容复杂,产生影响广泛,后续时间较长,但是部分干警在应对群体性事件时,不太善于做群众工作,表现出危机意识不强、缺乏与媒体的合作交流、工作方法不适应时代要求等问题.究其原因在于思想认识不够深刻、工作作风不够扎实和群众基础不够牢固.为此,要在把握西部边境民族地区群体性事件中群众工作特点规律的基础上,提高思想认识,强化服务理念,创新工作方法,增强实践本领,用好群众工作的传家宝.
